OCD In Kinayah Statements Of Divorce

Question:

 

 

Assalamualikum Mufti sahab,

 

Few questions i have.

 

  1. Does typing or pressing the symbol ‘X’ considered typing a kinaya word?

 

  1. While reading Salah, i read Surah Al Kawthar, in which in second ayah we have “وَٱنۡحَرۡ” , does saying this count as kinaya?

 

I searched google and the word means to sacrifice. Is “Sacrifice ” a kinaya word?

 

 

I have a ocd problem which i am suffering from 2 to 3 years now. Am i a mazoor in this case? Will having waswas of niyyat or the terms coming in mind as statement of niyyat ,  while saying these terms consider as niyyat or just waswas?

 

I am having serious trouble and its effecting my deen and as well as dunya.

 

Please answer all the above questions.

Answer:

 

 

Wa alaykum Assalaam

 

 

Talaq kinayah/ implicit divorce

 

For a statement to be considered a kinayah for talaq, it has to be such a statement which does not explicitly refer to talaq, but could suggestively imply talaq in an indirect/implicit sense.

 

E.g. leave and move back with your family

You are free and single

 

Neither statements “X” nor “ وانحر” (sacrifice) imply talaq in any way whatsoever.

 

Thus, neither words constitute talaq, no matter what your intention is for uttering or typing these words.

 

 

Obsessive Compulsive Disorder

 

As for your second question, talaq occurs from any person who is mature (reached puberty) and rational (has intellect and is not mentally insane). You are not معذور (excused) in the sense that if you pronounce a statement of Talaq to your wife, it WILL occur and be binding. This is because you are considered mentally rational, even if Shaytan constantly whispers doubts into your mind.

 

You need to fight your waswasa and not pay heed to the whispers and doubts caused by Shaytan. You also need to seek medical help for your OCD. Finally, please stay in a state of constant Dhikr (Rememberance of Allah Ta’ala) in order to ward off the Shaytan ‘s whispers. Allah Ta’ala says in the Noble Quran:

 

{ وَمَن یَعۡشُ عَن ذِكۡرِ ٱلرَّحۡمَـٰنِ نُقَیِّضۡ لَهُۥ شَیۡطَـٰنࣰا فَهُوَ لَهُۥ قَرِینࣱ }

[Surah Az-Zukhruf: 36]

 

And whoever is blinded from remembrance of the Most Merciful – We appoint for him a devil, and he is to him a companion.

 

Thus, recite your daily Adhkar and Wazeefah duas to protect against the Shaytan. Finally, consider your thoughts as being waswasa, and NOT an intention to give talaq. Again, seek immediate help from a doctor so that your brain is not constantly filled with doubts in regards to your marriage.
