Praying Salah in a Masjid which was built on someone else’s land

Question:

Our local mosque was established some 40 years ago. At the time of demarcation of land it is said and believed to be genuine that about 200-300 Sq ft of land which belonged to some local felt under the base of mosque. even though local community approached him to forgive and gift the same to mosque or to get a consideration for the same but the owner denied. Now some people are not offering Nimaz in the mosque stating same is useless exercise. Please guide us as to what is rightful approach and what shall we do?

Answer:

Bismillah

In the name of Allah, the most Beneficent, the most Merciful.

If it is the case that 200-300 sq. meters of the plot of land where the Masjid is belongs to another person and permission was not taken from him to build the Masjid on top, then it will be considered Makruh Tahrimi to pray in that Masjid. (Fatawa Mahmoodiyah p.168 v.6)
