Question:
The mas’alah where you do Qurbani on behalf of someone upon whom Qurbani is wajib and they haven’t consented. The animal should be okay for everyone for Qurbani still, no? That person’s share will count as nafl
In the name of Allāh, the Most Gracious, the Most Merciful
Answer:
You do not need consent to perform Nafl Qurbāni on behalf of another. However, if Qurbāni is Wājib on them, then consent is necessary for the fulfilment of that obligation. [Fatāwā Hindiyah: vol. 5, pg. 293, 302] [1]
If it is still possible for them to still do the Qurbāni then they must do so as the obligation remains. However, if the time has passed, then they can give that equivalent amount in charity to the poor instead. [Radd ul-Muhtār: vol 6, pg. 320] [2]
Only Allāh Ta’ālā knows best.
