Question:
I will be highly appreciate if you kindly clarify the following confusion. I have bought “Critical Illness” 25 years ago and I have paid $74.07 per month, total of $22,200 approx. There is a clause in the policy that I will get my principal back if I do not have any critical illness, i.e. cancer, heart attack, transplant etc. I am 61 years and got very sick and need transplant. Soon I will be qualify for the Critical Illness Insurance which is $100,000 (one hundred thousand dollar).
My question is can I keep the total 100 K for myself and family and is it halal? If not, can I keep my principal what I paid, $22,000 and give the rest to needy in the family and charity?

Answer:
Insurance is forbidden in Islam due to the element of impermissibility such as interest, uncertainty and gambling.
However due to necessity and difficulty, at times some scholars give concession to it. However it will be limited to the usage.
Thus if a person is qualify for the medical insurance, he may use it for that purpose. It will not be permissible for personal use.
However if he is not using the money for that purpose, he may take what he gave and the balance must be given to the poor without the intention of reward. After that one should engage in tawbah and istighfar.

فإذا تصدق بالمال الحرام يريد القبول والأجر يحرم عليه ذلك، وأما إذا كان عند رجل مال خبيث، فإما إن ملكه بعقد فاسد، أو حصل له بغير عقد، ولا يمكنه أن يردّه إلى مالكه، ويريد أن يدفع مظلمته عن نفسه، فليس له حيلة إلَّا أن يدفعه إلى الفقراء
