Ruling on the Validity of a Faskh-e-Nikah (Annulment) from Pakistan for a Hanafi Woman

Question:

 

I got a fask e nikhah from Pakistan.

 

Before going to the court, I tried that he gives me talaq or khula, I Even proposed him to take money from me.

 

At the end, I was obliged to go to the court, because he wasn’t giving me Khula and things have become so bad, that it was impossible to reconcile.

 

I am a hanafi, can I have a fatwa according to the hanafi, if it is a valid divorce and can I marry someone else.

 

 

In the name of Allah, the Most Gracious, the Most Merciful

 

Answer:

 

A divorce issued through an Islamic Court or Shari’ah Council is a valid divorce. Therefore, with the annulment (faskh) issued by the Islamic court you are now permitted to marry someone else.

الطَّلَاقُ بِصَرِيحِهِ، وَكِنَايَاتِهِ، وَلَهُ كِتَابٌ مُفْرَدٌ، وَمِنْهَا اللِّعَانُ وَلَا تَقَعُ الْفُرْقَةُ إلَّا بِتَفْرِيقِ الْقَاضِي عِنْدَ أَصْحَابِنَا.
