Ruling On Uttering The Words “I Divorced Her” Three Times While Claiming It Was A Lie & Without Intention Of Divorce

Question:

 

I lied to mother that I gave divorce to my wife. My actual words were as these: I divorced her, I divorced, I divorced her.  I said these words “I divorced her”, “I divorced her”, “I divorced her” when my wife was also sitting in front of me. We (My Wife and I) had a rift and we were fighting and I stopped the fight by addressing these words “I divorced her” “I divorced her” “I divorced her”  to my mother (what I addressed to my mother was a lie, I never have or had an intention to divorce my wife).

 

Just in order to make my wife stop yelling at me, I pronounced these words “I divorced her” “I divorced her” “I divorced her” (but as said It was a lie and it was addressed to my mother and not to my wife). Does this mean that the divorce has occurred?

Answer:

 

Dear brother, regarding divorce the Sharia has very clear guidelines. Explicit expression of divorce will make the divorce occur irrespective of one’s intentions.

 

As your expression of divorce is explicit, your Nikkah is ended from that moment onwards. An irrevocable divorce will have occurred. This means she will be out of your Nikkah, and she will not be able to return until she has married someone else, consummated that marriage, and dissolved that marriage The lady’s iddah (waiting period until she can re-marry someone else) will start from after your first expression of “I divorced her”.

(وَفِيهِ خَمْسَةَ عَشَرَ بَابًا)

(الْبَابُ الْأَوَّلُ فِي تَفْسِيرِهِ وَرُكْنِهِ وَشَرْطِهِ وَحُكْمِهِ وَوَصْفِهِ وَتَقْسِيمِهِ وَفِيمَنْ يَقَعُ طَلَاقُهُ وَفِيمَنْ لَا يَقَعُ طَلَاقُهُ)

(أَمَّا تَفْسِيرُهُ) شَرْعًا فَهُوَ رَفْعُ قَيْدِ النِّكَاحِ حَالًا أَوْ مَآلًا بِلَفْظٍ مَخْصُوصٍ كَذَا فِي الْبَحْرِ الرَّائِقِ

(وَأَمَّا رُكْنُهُ) فَقَوْلُهُ: أَنْتِ طَالِقٌ. وَنَحْوُهُ كَذَا فِي الْكَافِي

(وَأَمَّا شَرْطُهُ) عَلَى الْخُصُوصِ فَشَيْئَانِ (أَحَدُهُمَا) قِيَامُ الْقَيْدِ فِي الْمَرْأَةِ نِكَاحٍ أَوْ عِدَّةٍ (وَالثَّانِي) قِيَامٌ حَلَّ مَحِلَّ النِّكَاحِ حَتَّى لَوْ حُرِّمَتْ بِالْمُصَاهَرَةِ بَعْدَ الدُّخُولِ بِهَا حَتَّى وَجَبَتْ الْعِدَّةُ فَطَلَّقَهَا فِي الْعِدَّةِ لَمْ يَقَعْ لِزَوَالِ الْحِلِّ وَإِذَا طَلَّقَهَا ثُمَّ رَاجَعَهَا يَبْقَى الطَّلَاقُ وَإِنْ كَانَ لَا يُزِيلُ الْحِلَّ وَالْقَيْدَ فِي الْحَالِ لِأَنَّهُ يُزِيلُهُمَا فِي الْمَآلِ حَتَّى انْضَمَّ إلَيْهِ ثِنْتَانِ كَذَا فِي مُحِيطِ السَّرَخْسِيِّ

(وَأَمَّا حُكْمُهُ) فَوُقُوعُ الْفُرْقَةِ بِانْقِضَاءِ الْعِدَّةِ فِي الرَّجْعِيِّ وَبِدُونِهِ فِي الْبَائِنِ كَذَا فِي فَتْحِ الْقَدِيرِ. وَزَوَالُ حِلِّ الْمُنَاكَحَةِ مَتَى تَمَّ ثَلَاثًا كَذَا فِي مُحِيطِ السَّرَخْسِيِّ.

(وَأَمَّا وَصْفُهُ) فَهُوَ أَنَّهُ مَحْظُورٌ نَظَرًا إلَى الْأَصْلِ وَمُبَاحٌ نَظَرًا إلَى الْحَاجَةِ كَذَا فِي الْكَافِي. (وَأَمَّا تَقْسِيمُهُ) فَإِنَّهُ نَوْعَانِ سُنِّيٌّ وَبِدْعِيٌّ وَكُلُّ وَاحِدٍ مِنْهُمَا نَوْعَانِ نَوْعٌ يَرْجِعُ إلَى الْعَدَدِ وَنَوْعٌ يَرْجِعُ إلَى الْوَقْتِ

وَإِذَا قَالَ الرَّجُلُ لِامْرَأَتِهِ أَنْتِ طَالِقٌ وَلَا يَعْلَمُ مَعْنَى قَوْلِهِ أَنْتِ طَالِقٌ فَإِنَّهُ يَقَعُ الطَّلَاقُ وَإِذَا قَالَ لِامْرَأَتِهِ أَنْتِ طَالِقٌ وَلَا يَعْلَمُ أَنَّ هَذَا الْقَوْلَ طَلَاقٌ طَلُقَتْ فِي الْقَضَاءِ وَلَا تَطْلُقُ فِيمَا بَيْنَهُ وَبَيْنَ اللَّهِ تَعَالَى هَكَذَا فِي الذَّخِيرَةِ
