Shaving the Hair in Umrah

Question:

 

My question is related to my second Umrah which I performed in Makkah 2 years ago where I used a zero number machine to remove hair even though the hair was significantly less as I had done the first umrah 2-3 days earlier and shaved all the hair using the same machine.

 

‌One of my friends told me that we can use it even if we have little hair. So I did the same for 2nd umrah. After that, I checked online which mentioned that if one is Ḥanafī then 1/3 length is mandatory and cut is not allowed. In other fiqh it is fine but shaving is preferred.

 

‌I was very depressed and angry with myself but did not have knowledge on what to do as I had already removed Iḥrām sheets.

 

‌I checked with many people and they said no there is no issue because the Qur’ān verse says either you shave or cut. The length is unspecified however shaving is better. They suggested I do an umrah and shave before Ḥajj. I did an Umrah again after a week and shaved before Ḥajj.

 

‌Can I take other fiqh opinions (as in their case, length is not mandatory for trim) or should I pay dum whenever I get the chance to? If yes, then how many dums? Is one dum okay?

 

‌I am getting thought about this mistake and I am getting depressed. I had already asked for forgiveness but still, I get thoughts

Answer:

 

If a male has very little hair on their head, upon completing the actions of irām, awāf and sa’īe, he must shave his hair (wujūban) to get out of the sacred state of iram to conclude the ‘Umrah, according to the Ḥanafī school. In your described situation, you remained in irām of ‘Umrah until you shaved prior to your Ḥajj. Since you most likely engaged in actions contrary to iḥrām requirements before the final shave [such as wearing stitched clothing], a dumm (animal sacrifice) is mandatory. – (See: Rad Al-Muḥtār, Vol 2, Page 5161 and 5472 Dār Al-Fikr, Badā’i Al-Ṣanāi’, Vol 2, Page 140, Dār Al-Kutub Al-‘Ilmīyyah3)

 

“With your heads shaved and [hair] shortened.” – (Qurʿān 48:27)4

 

“Mughīrah reported from Ibrāhīm that the pilgrim should trim at least the quantity of a fingertip (an inch).” – (Muṣannaf Ibn Abī Shaybah 12917)5

 

‘Abd Allāh ibn ‘Abbās (may Allāh be pleased with him) said, “If someone forgets anything of the pilgrimage rituals or omits them intentionally, they must slaughter an animal.” – (Mu’attā Mālik 946)6

2 فَلَوْ لَبِسَ مِنْ نِصْفِ النَّهَارِ إلَى نِصْفِ اللَّيْلِ مِنْ غَيْرِ انْفِصَالٍ أَوْ بِالْعَكْسِ لَزِمَهُ دَمٌ – كتاب الدر المختار وحاشية ابن عابدين رد المحتار ج٢/ ص ٥٤٧ دار الفكر

 

3 فَالْحَلْقُ أَوْ التَّقْصِيرُ وَاجِبٌ عِنْدَنَا إذَا كَانَ عَلَى رَأْسه شَعْرٌ لَا يَتَحَلَّلُ بِدُونِهِ وَعِنْدَ الشَّافِعِيِّ لَيْسَ بِوَاجِبٍ – كتاب بدائع الصنائع في ترتيب الشرائع ج٢/ ص ١٤٠ دار الكتب العلمية

 

4 لَتَدْخُلُنَّ الْمَسْجِدَ الْحَرَامَ إِن شَاءَ اللَّهُ آمِنِينَ مُحَلِّقِينَ رُءُوسَكُمْ وَمُقَصِّرِينَ – سورة الفتح ٢٧

 

5 اخرجه مصنف ابن أبي شيبة ١٢٩١٧ مكتبة الرشد – عَنْ مُغِيرَةَ عَنْ إِبْرَاهِيمَ قَالَ تُقَصِّرُ مِنْ شَعْرِ قَدْرَ أُنْمُلَةٍ

 

6 عَنْ عَبْدِ اللَّهِ بْنِ عَبَّاسٍ قَالَ مَنْ نَسِيَ مِنْ نُسُكِهِ شَيْئًا أَوْ تَرَكَهُ فَلْيُهْرِقْ دَمًا – اخرجه مالك في المؤطأ ٩٤٦
