Question:

Some people bought a house and turned it into a masjid with the intention of the ground floor for jamāt khānah (prayer hall). Now they have built a new floor on top but with intention of a madrasah for men and women. Is that floor considered masjid? Should aḥkām (rulings) of jamāt khānah (prayer hall) be applied to that floor?

Answer:

Once a structure is designated as a masjid and made waqf, then everything above and below it is considered part of the masjid. The rulings of the masjid will apply in the space above it as well, even though the space is used as a classroom or madrasah Islamic school. – (See: Rad Al-Muḥtār, Vol 4, Page 357¹ & Vol 1, Page 656, Dār Al-Fikr²)
