Question:

 

My father would like me to purchase a home for him as our current rented flat is making him depressed. This will require me to take out a mortgage. He will remain in that home until he passes and most likely we will sell it at that point and/or rent it out.

 

Me and my brother will remain in our current rented property in London

 

Is taking out a mortgage (and the interest involved with it) permissible for this purpose?

 

 

In the name of Allah, the Most Gracious, the Most Merciful

 

Answer:

 

Mortgages with interest are impermissible.

 

This is strictly prohibited in the Quran in verses 275-279 of Surat-ul-Baqarah. This culminates in Allah, Most High. Telling us ‘O those who believe, fear Allah and leave what remains of interest, if you believe. If you do you not do so, then be aware of a war from Allah and His Messenger (may Allah send His blessings and peace upon him, and if you repent then for you is your principal, (you are) not oppressing nor oppressed.¹

 

There is a principle taken from hadith:

 

وَعَنْ عَلِيٍّ رَضِيَ اللَّهُ عَنْهُ قَالَ: قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: «لَا طَاعَةَ فِي مَعْصِيَةٍ إِنَّمَا الطَّاعَةُ فِي الْمَعْرُوف»

 

Mishkat al-Masabih 3665 (Found in Bukhari and Muslim)

 

The Blessed Messenger, may Allah send prayers and peace upon him, said “There is no obedience in sin there is only obedience in good.”

 

 

حَدَّثَنَا عَبْدُ الرَّحْمَنِ، حَدَّثَنَا سُفْيَانُ، عَنْ زُبَيْدٍ، عَنْ سَعْدِ بْنِ عُبَيْدَةَ، عَنْ أَبِي عَبْدِ الرَّحْمَنِ، عَنْ عَلِيٍّ، رَضِيَ اللَّهُ عَنْهُ عَنْ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ لَا طَاعَةَ لِبَشَرٍ فِي مَعْصِيَةِ اللَّهِ‏.‏

 

Musnad Ahmad 1065

 

The Blessed Messenger, may Allah send prayers and peace upon him, said “There is no obedience to humans in the disobedience of Allah.”

 

With respect to parents, one cannot obey them in disobedience of Allah. So in conclusion, no it is not permitted to take the mortgage.

 

 

1. 1 Al-Quran:

 

ٱلَّذِينَ يَأْكُلُونَ ٱلرِّبَوٰا۟ لَا يَقُومُونَ إِلَّا كَمَا يَقُومُ ٱلَّذِى يَتَخَبَّطُهُ ٱلشَّيْطَـٰنُ مِنَ ٱلْمَسِّ ۚ ذَٰلِكَ بِأَنَّهُمْ قَالُوٓا۟ إِنَّمَا ٱلْبَيْعُ مِثْلُ ٱلرِّبَوٰا۟ ۗ

وَأَحَلَّ ٱللَّهُ ٱلْبَيْعَ وَحَرَّمَ ٱلرِّبَوٰا۟ ۚ فَمَن جَآءَهُۥ مَوْعِظَةٌۭ مِّن رَّبِّهِۦ فَٱنتَهَىٰ فَلَهُۥ مَا سَلَفَ وَأَمْرُهُۥٓ إِلَى ٱللَّهِ ۖ وَمَنْ عَادَ فَأُو۟لَـٰٓئِكَ أَصْحَـٰبُ ٱلنَّارِ ۖ هُمْ فِيهَا خَـٰلِدُونَ

يَمْحَقُ ٱللَّهُ ٱلرِّبَوٰا۟ وَيُرْبِى ٱلصَّدَقَـٰتِ ۗ وَٱللَّهُ لَا يُحِبُّ كُلَّ كَفَّارٍ أَثِيمٍ

إِنَّ ٱلَّذِينَ ءَامَنُوا۟ وَعَمِلُوا۟ ٱلصَّـٰلِحَـٰتِ وَأَقَامُوا۟ ٱلصَّلَوٰةَ وَءَاتَوُا۟ ٱلزَّكَوٰةَ لَهُمْ أَجْرُهُمْ عِندَ رَبِّهِمْ وَلَا خَوْفٌ عَلَيْهِمْ وَلَا هُمْ يَحْزَنُونَ

يَـٰٓأَيُّهَا ٱلَّذِينَ ءَامَنُوا۟ ٱتَّقُوا۟ ٱللَّهَ وَذَرُوا۟ مَا بَقِىَ مِنَ ٱلرِّبَوٰٓا۟ إِن كُنتُم مُّؤْمِنِينَ

فَإِن لَّمْ تَفْعَلُوا۟ فَأْذَنُوا۟ بِحَرْبٍۢ مِّنَ ٱللَّهِ وَرَسُولِهِۦ ۖ وَإِن تُبْتُمْ فَلَكُمْ رُءُوسُ أَمْوَٰلِكُمْ لَا تَظْلِمُونَ وَلَا تُظْلَمُونَ
