Question: 

Asalmualykum Mufti Saab. I hope all is well.

I had a question about the topic of waqf.

I understand that if someone were to donate a mushaf to the masjid for the sake of Allah intending that it is for the masjid. This now becomes a waqf.

My question is that if a masjid itself purchases مصاحف for the masjid, I believe this is also a waqf? Is that true?

My follow up question is that: Some people may not have a certain print of the Quran. However, when they come to the masjid, they see a print that they really like but cannot find anywhere. They ask if they can take it.

Should permission be given to take that copy of the Quran home?

Answer:

Wa ʿalaykumu s-salam waRahmatullahi Wabarakatuh,

When a waqf (endowment) is established and deemed valid, the ownership of the property transfers from the person who initiated the waqf (waqif) to Allah’s ownership.

As a result, the property can no longer be sold, gifted, or transferred in ownership to anyone else. This principle is agreed upon by all jurists.

«مختصر القدوري» (ص127):
«وإذا صاح الوقف ‌لم ‌يجز ‌بيعه ‌ولا ‌تمليكه»

«الجوهرة النيرة على مختصر القدوري» (1/ 336):
«قَوْلُهُ (‌وَإِذَا ‌صَحَّ ‌الْوَقْفُ ‌لَمْ ‌يَجُزْ ‌بَيْعُهُ وَلَا تَمْلِيكُهُ) إلَّا أَنْ يَكُون مُشَاعًا عِنْدَ أَبِي يُوسُفَ فَيَطْلُبُ الشَّرِيكُ الْقِسْمَةَ فَتَصِحُّ مُقَاسَمَتُهُ أَمَّا امْتِنَاعُ الْبَيْعِ وَالتَّمْلِيكِ فَلِأَنَّهُ قَدْ زَالَ مِلْكُهُ عَنْهُ.»

«فتح القدير للكمال بن الهمام – ط الحلبي» (6/ 220):
«وَإِذَا صَحَّ الْوَقْفُ خَرَجَ عَنْ مِلْكِ الْوَاقِفِ. ثُمَّ قَوْلُهُ (‌لَمْ ‌يَجُزْ ‌بَيْعُهُ ‌وَلَا ‌تَمْلِيكُهُ) هُوَ بِإِجْمَاعِ الْفُقَهَاءِ»

«اللباب في شرح الكتاب» (2/ 184):
«(‌وإذا ‌صح ‌الوقف ‌لم ‌يجز ‌بيعه ولا تمليكه) ؛ لخروجه عن ملكه»
