Touching daughter with lust

Question:

As Salaamu Alaykum wa Rahmatullahi Wa Barakaatuh

Hazrat, please bear in mind, I am not after any references if time is of
the essence, and short answer will suffice. Please also note this
question is of sensitive nature, but Islam encourages to ask if we do
not know.

My question is:

(1) If a father touches his daughter, or look sat her with lusfal gazes is
his nikah with his wife terminated unconditionally?

(2) If true how literal do we mean? Is it safe to say that if he inhibits
paedophilia-like desires/impulses towards his daughter at the point when
she's mature _then_ the nikah is terminated?

(3) In addition, what if thoughts of another women comes to his mind as a
result of looking at his daughter is the nikah terminated?

Please clarify clearly, and factually. This question is of great concern
to me, and my wife.

Answer:

Bismillah

  1. When the father touches any part of the body or looks at the inner private part of his daughter with lust and desire the ruling of hurmatulmusaharahwill take effect. This means that his wife will become unconditionally prohibited for him and the marriage will no longer remain valid.

  2. The marriage of the father will only be terminated if the father acts on these impulses either by engaging in sexual activity, touching or looking at the private part with desire as mentioned above of the daughter (may Allah protect us from this).

By looking at any other part of the body other than the private parts with desire, the above mentioned ruling will not take effect.

  1. The mere fantasising of another woman when looking at the daughter will not terminate the father’s marriage although this is a sinful act.[1]
