Validity of Divorce Under the Influence of Black Magic

Question: Respected Mufti Sahab,

My name is Abid Ansari. My parents do not like my wife and have performed black magic on me so that I would divorce her. They were doing this for the past two months and checking if it worked. I was completely unaware, though my uncle and aunts argued, “Abid, your mental health is not okay,” yet I ignored them. This happened during October-November 2024.

Finally, I divorced my wife on 22nd December 2024, and my parents became very happy, even dancing. When I asked them about it, they remained silent and did not tell me anything.

I was deeply upset and asked Allah for help through night prayers (I have been offering Salah regularly since it became Fardh and performed Hajj in 2024). Then, on 4th January 2024, Alhamdulillah, by the grace of Allah, I saw Hazrat Muhammad (PBUH) for the second time in my life—the first time was in Madinah in 2023. PBUH told me that my divorce is invalid and gave me some hints.

I was extremely troubled and could not sleep for over a week. I persistently asked my parents and my close friend, who was involved in the black magic. On 14th January, they confirmed that they had been doing this for the past two months and had controlled my brain so that I would act as they wished. My wife had told me, “You are not in a state of your mind,” but I did not listen as I was entirely under their control.

On 15th January, I again saw one of the Sahabah between Tahajjud and Fajr time, who confirmed that my parents had performed black magic and used Surah Baqarah Ayah 102 as part of their practice. I insisted again, and when they asked me, “Who is confirming our insights?” I responded, “Allah Subhanahu wa Ta’ala. May He grant you guidance—what kind of parents are you?”

I referred to Fatwa No. 01254, which states that if black magic is severe, the divorce becomes null and void.

I have also reviewed many other fatwas confirming that if I take an oath stating that I was under black magic, and my uncle and aunt confirm the same, then we have regained our marital status.

However, I wish to hear from you and am ready to disclose any further information if required.

In the name of Allah, the Most Gracious, the Most Merciful

Answer: A person cannot and should not be forced into marriage or divorce against their will. This contradicts the fundamental teachings of Islam, as both Nikah and Talaaq should be done willingly and as a personal choice, even if they are not decided with equal enthusiasm.

Regarding your final question: if your uncle and aunt can confirm and bear testimony that you were under the state of black magic, then the effect of Talaaq will not have taken place. This is because you were not in control of your senses or faculty of intelligence at the time, meaning you were not conscious or aware of what you were saying when you uttered the words of Talaaq.

Therefore, the divorce would not stand, and you would still be considered married to your wife.

وَأَهْلُهُ زَوْجٌ عَاقِلٌ بَالِغٌ مُسْتَيْقِظٌ (قَوْلُهُ وَأَهْلُهُ زَوْجٌ عَاقِلٌ إلَخْ) احْتَرَزَ بِالزَّوْجِ عَنْ سَيِّدِ الْعَبْدِ وَوَالِدِهِ الصَّغِيرِ، وَبِالْعَاقِلِ وَلَوْ حُكْمًا عَنْ الْمَجْنُونِ وَالْمَعْتُوهِ وَالْمَدْهُوشِ وَالْمُبَرْسَمِ وَالْمُغْمَى عَلَيْهِ

فتاوى علاج المسحور عند المشعوذ سؤال: بعض الناس إذا أصيب له مريض بالصرع يذهب به إلى بعض الأطباء العرب، وهؤلاء يستحضرون وتصدر منهم حركات غريبة، ويحجبون المريض فترة من الزمن ويقولون: إنه مصاب بالجن أو مسحور ونحو ذلك، ويعالج هؤلاء المريض ويشفى ويدفع لهم الأموال مقابل ذلك، فما الحكم في ذلك؟ وما الحكم أيضا في العلاج بالعزائم، التي تكتب فيها الآيات القرآنية ثم توضع في وتشرب؟

الجواب: علاج المصروع والمسحور بالآيات القرآنية والأدوية المباحة لا حرج فيه إذا كان ذلك ممن يعرف بالعقيدة الطيبة والالتزام بالأمور الشرعية. أما العلاج عند الذين يدعون علم الغيب أو يستحضرون الجن أو أشباههم من المشعوذين أو المجهولين الذين لا تعرف حالهم ولا تعرف كيف علاجهم، فلا يجوز إتيانهم ولا سؤالهم ولا العلاج عندهم، لقول النبي صلى الله عليه وسلم: «من أتى عرَّافا فسأله عن شيء لم تقبل له صلاة أربعين ليلة» أخرجه مسلم في صحيحه.

المبحث الرابع: رؤية البشر لربهم في الحياة الدنيا لعل من المناسب بعد ذكر ما يتعلق بمسألة رؤية النبي صلى الله عليه وسلم لربه، وما يتصل بها من مسائل، الإشارة إلى مسألة رؤية البشر لربهم في الحياة الدنيا، وذلك لما بين المسألتين من ترابط من جهة وجود نوع علاقة بين المسألتين، باعتبار أن من زعم جواز حصول الرؤية للبشر استند في زعمه على ما ذكر من أحاديث مكذوبة في وقوع الرؤية للنبي صلى الله عليه وسلم في الحياة الدنيا، ومعلوم أن بضاعة المتصوفة الذين جوزوا حصول ذلك لأوليائهم هي الأحاديث المكذوبة…
