Question:

 

What is a nikah faduli/ fazuli? Is it a valid nikah without the presence of witnesses?

 

 

In the name of Allah, the Most Gracious, the Most Merciful

 

Answer:

 

Nikah Faduli is when someone carries out the Nikah on behalf of the two parties for example he says I have carried out the marriage of so and so with so and so while they are both not present, according to Abu Hanifah and Muhammed it is not valid even if the news reaches both parties and they consent and according to Abu Yusuf it is valid if they both consent. If someone says I have married so and so with so and so while they are both absent and a representative of the man agrees the marriage will be valid even with their consent.[1]

وعلى هذا الخلاف الفضولي الواحد من الجانبين بأن قال الرجل زوجت فلانة من فلان و هما غائبان لم ينعقد عندهما حتى لو بلغهما الخبر فأجازا لم يجز و عنده ينعقد و يجوز بالإجازة و لو قال فضولي زوجت فلانة من فلان و هما غائبان فقبل فضولي آخر عن الزوج ينعقد بلا خلاف بين أصحابنا حتى إذا بلغهما الخبر و أجازا جاز
