What Is the Condition for Hurmat-E-Musaharah

Question:

 

Mufti Sahab, can you please tell me what is the condition for hurmat-e-musaharah? I have read on your website that looking at a mahram with lust does not establish hurmat unless that person looks at the private part of the mahram with lust (Astaghfirullah). Is this the opinion of Mufti Taqi Usmani Sahab (Daamat Barkatuhum) as well?

 

Also, please explain how unintentionally having lust can establish hurmat-e-musaharah when our Prophet Muhammad (Sallallahu ‘Alayhi Wa Sallam) said that actions are by intentions. A person feels ashamed to feel about his mahram in a lustful way but still gets an erection and lust so he didn’t mean it. Why is his Nikah broken?

Answer:

 

Hurmah Musaharah will be established when a valid Nikah and when sexual intercourse has been performed between a couple, so their relatives will be forbidden upon each other including The father, grandfather, great grandfather, of the husband, the mother, grandmother, great grandmother, the daughters of the wife, the son and his wife, grandson, great-grandson of the husband, the daughter, granddaughter, great-granddaughter of the husband and so forth. If someone performs adultery or touches or kisses or looks at the private parts with lust then Hurmah Musaharah will be established, this touching will be directly on the skin or over a cloth by which the heat of the body can be felt, just by looking at this person and not their private parts with lust will not establish Hurmah Musaharah but is a grave sin and one should repent. Mere thoughts of lust that do not involve touching will not establish Hurmah Musaharah as it is thoughts from the devil which should be ignored and will not be accountable if one regrets this but if touching is involved by which an erection or orgasm occurs then Hurmah Musaharah will be established.[1]

*وكما تثبت هذه الحرمة بالوطء تثبت بالمس والتقبيل والنظر إلى الفرج بشهوة ، كذا في الذخيرة .*فإن نظرت المرأة إلى ذكر الرجل أو لمسته بشهوة أو قبلته بشهوة تعلقت به حرمت المصاهرة ، كذا في الجوهرة النيرة .*ولا تثبت بالنظر إلى سائر الأعضاء إلا بشهوة ولا بمس سائر الأعضاء لا عن شهوة بلا خلاف ، كذا في البدائع .*ثم المس إنما يوجب حرمة المصاهرة إذا لم يكن بينهما ثوب ، أما إذا كان بينهما ثوب فإن كان صفيقا لا يجد الماس حرارة الممسوس لا تثبت حرمة المصاهرة وإن انتشرت آلته بذلك وإن كان رقيقا بحيث تصل حرارة الممسوس إلى يده تثبت ، كذا في الذخيرة .
