Question:

A person leaves Makkah and goes to Taaif (outside of Miqat) and returns back to makkah without coming into ihram. In this situation he must return back to a miqat and perform ‘Umrah otherwise dum will be necessary.

If the person leaves Makkah and goes to Madinah without having performed umrah, does he still have the option to do an umrah? Or will he have to give dum now?

Answer:

If the person left Makkah and travelled to Madinah without the intention of performing ʿUmrah, then when he returns from Madinah, he can enter into ihrām from Dhul-Ḥulayfah (miqāt of Madinah) and perform ʿUmrah, no dam is necessary.

However, if he passed the miqat (e.g. Dhul-Ḥulayfah) while intending to do ʿUmrah but did not enter into ihram, then he must return to the miqat and put on ihram, otherwise dam will be necessary.
