Question:
What is the ruling on a woman who refuses her husband to see the children? Also, what is the ruling on women who claim their husband’s assets after divorce?
In the name of Allah, the Most Gracious, the Most Merciful
Answer:
A woman should allow her children to see their father. She should not take her children out of the city as it would cause harm to the father (Mukhtarat Al Nawazil, Vol 2, Pg 189-190).
If a woman breaks the ties of kinship between a father and his children, she would be sinful. Allah (SWA) says in the Qur’an:
“Now if you turn away, perhaps you would then spread corruption throughout the land and sever your kinship! These are the ones who Allah has condemned, deafening them and blinding their eyes” (Qur’an, 47:22-23)
“But those who break the covenant of Allāh after contracting it and sever that which Allāh has ordered to be joined and spread corruption on earth – for them is the curse, and they will have the worst home” (Qur’an, 13:25)
Men are responsible for paying Nafaqah (expenses) and providing housing for their divorced wives during the Iddah period (Fatawa Qazi Khan, Vol 1, Pg 380). It is not permissible for a woman to take anything beyond these expenses.
To conclude, it is impermissible for a woman to prevent her husband from seeing his children and for her to take her husband’s assets after divorce.
و إذا ارادت المرأة أن تخرج بولدها منه ليس لها ذلك ايضا لما فيه من الإضرار بالأب
فَهَلْ عَسَيْتُمْ إِن تَوَلَّيْتُمْ أَن تُفْسِدُوا۟ فِى ٱلْأَرْضِ وَتُقَطِّعُوٓا۟ أَرْحَامَكُمْ أُو۟لَـٰٓئِكَ ٱلَّذِينَ لَعَنَهُمُ ٱللَّهُ فَأَصَمَّهُمْ وَأَعْمَىٰٓ أَبْصَـٰرَهُمْ
وَٱلَّذِينَ يَنقُضُونَ عَهْدَ ٱللَّهِ مِنۢ بَعْدِ مِيثَـٰقِهِۦ وَيَقْطَعُونَ مَآ أَمَرَ ٱللَّهُ بِهِۦ أَن يُوصَلَ وَيُفْسِدُونَ فِى ٱلْأَرْضِ أُو۟لَـٰٓئِكَ لَهُمُ ٱللَّعْنَةُ وَلَهُمْ سُوٓءُ ٱلدَّارِ
المعتدة عن الطلاق تستحق النفقة و السكني كان الطلاق رجعيا أو بائنا أو ثلاثا حاملا كانت المرأة أو لم تكن
