When Would I Be Considered to Be a Traveler

Question-

 

Assalamu alaikum Mufti saheb.

Kindly enlighten me, I understood that becoming Musafir is something which happens with

1. Niyyah to travel 48 miles or more

2. Leaving the boundaries of the town

So in the enquired, situation, when the brother left his home town, he only intended travel for 44 miles, so even if he drives 70 miles, he will not be Musafir because of his niyyah initially

 

 

بِسْمِ اللهِ الرَّحْمنِ الرَّحِيْم

In the name of Allah, the Most Gracious, the Most Merciful.

 

 

Answer

 

Yes, if the intention was made when initially leaving that you are going to travel and therefore the rulings of travel will apply to you, then you will be considered a Musafir.

 

However, if your intention was not to travel but rather to do something else and you happened to exceed the limit of travel then you will not be considered a Musafir.[1]

 

In essence, three things are looked at when traveling:

  1. The duration of travel
  2. The intention
  3. Leaving the buildings of the locality of residence[2]

 

 

And Allah SWT alone knows best.
