Question
Assalamu Alaikum, hope all is well. Would it be permissible to sell frozen goat semen?
In the name of Allah, the Most Gracious, the Most Merciful
Answer:
عَنِ ابْنِ عُمَرَ، قالَ: كانَ رَسُولُ اللَّهِ ﷺ يَكْرَهُ مِنَ الشّاةِ سَبْعًا: المَرارَةَ، والمَثانَةَ، والمحياة، والذَّكَرَ، والأُنْثَيَيْنِ، والغُدَّةَ، والدَّمَ، وكانَ أحَبَّ الشّاةِ إلى رَسُولِ اللَّهِ ﷺ مُقَدَّمُها، قالَ: وأُتِيَ النَّبِيُّ ﷺ بِطَعامٍ، فَأقْبَلَ القَوْمُ يُلْقِمُونَهُ اللَّحْمَ، فَقالَ رَسُولُ اللَّهِ ﷺ: إنَّ أطْيَبَ اللَّحْمِ لَحْمُ الظَّهْرِ
Abdullah Ibn Umar ( رضى الله عنهما )narrated that; “The Messenger of Allah ﷺused to dislike seven things of a goat:
(1) gall bladder, (2) bladder, (3) glands(4) the male organ (5) the female organ, (6) the thyroid, (7) blood,
The most beloved part of a goat to Messenger (صلى الله عليه وسلم) of Allah was the goat’s forefront and a sheep was bought to the Messenger of Allah ﷺ, and people turned to meat, so the Messenger of Allah ﷺsaid: “The most delicious meat is the back meat.” [1]
Narrated Anas bin Malik( رضى الله عنه )
عَنْ أَنَسِ بْنِ مَالِكٍ، أَنَّ رَجُلاً، مِنْ كِلاَبٍ سَأَلَ النَّبِيَّ صلى الله عليه وسلم عَنْ عَسْبِ الْفَحْلِ فَنَهَاهُ فَقَالَ يَا رَسُولَ اللَّهِ إِنَّا نُطْرِقُ الْفَحْلَ فَنُكْرَمُ . فَرَخَّصَ لَهُ فِي الْكَرَامَةِ .
“A man from (the tribe of) Kilab asked the Messenger of Allah ﷺ about studding a stallion and he prohibited it. So he said: ‘O Messenger of Allah! We stud the stallions so that we get honorarium (from the owners of the female horse)!’ So he permitted it for the honorarium.” [2]
قلنا: الإجماع يسقط قوله. وقد دل عليه نهيه – ﷺ – (عنعسب الفحل، ومعلوم أن النهى لم يتناول الفعل وإنما يتناول العقد عليه، ولأنه استئجار على عقد فكان فاسدًا
We said: The consensus falls short. It is indicated by his prohibition on the authority of the stallion, and it is known that the prohibition did not deal with the act, but rather it dealt with the contract on it, and because it was a hire on a contract, it was corrupt.[3]
(ولا يَجُوزُ أخْذُ أُجْرَةِ عَسْبِ الفَحْلِ) أيْ ضِرابِهِ (وهُوَ أنْ يُؤَجِّرَ فَحْلًا لِيَنْزُوَ عَلى الإناثِ
It is not permissible to take a wage for a stallion (i.e., to strike it), which is to rent a stallion for the sake of the females.[4]
ولَمْ يَنْعَقِدْ بَيْعُ المَلاقِيحِ والمَضامِينِ وعَسْبِ الفَحْلِ ولَبَنِ المَرْأةِ وفِي التَّلْوِيحِ المُتَقَوِّمُ ما يَجِبُ إبْقاؤُهُ بِعَيْنِهِ أوْ بِمِثْلِهِ أوْ بِقِيمَتِهِ والخَمْرُ يَجِبُ اجْتِنابُها بِالنَّصِّ فَلَمْ تَكُنْ مُتَقَوِّمَةً
Sale cannot take place of insemination of stallion and milk of a woman.[5]
In the aforementioned case, it is not permissible to sell goat semen as it is amongst those things which have no value even though it is from a halal animal and also due to ماحرمأخذهحرم إعطاؤه
“What is forbidden to take, is forbidden to give”.
