Would the Following Situation Count As Khula or Talaq Baain

Question:

 

My wife asked for separation she used the following terminology separation divorce talak. I always said to go to the Islamic Council to obtain a khula. She refused and said she would give up the dowery for the separation. To this I replied we both know where we stand. i.e you don’t wish to be with me you have opted to give up the dowery so there for ur request has been approved.

 

Would this fall under khula or tala bayin? If it falls under talak bayin does that dissolve the marriage?

Answer:

 

Words of Talaaq can be used to initiate Khula (Raddul Muhtar, Vol 5, Pg 91). (1) If you verbally accept the proposed Khula, then Talaaq Baain will occur (Badai Al Sanai, Vol 4, Pg 376 (2); Fatawa Hindiyyah, Vol 1, Pg 519). (3)

 

Although you did not use the words of Talaq or Khula in your response, as you replied, “we both know where we stand,” you intended to accept the Khula, therefore accepting divorce. As such, a Talaaq Baain will still occur (Badai Al Sanai, Vol 4, Pg 285). (4)

 

The marriage is dissolved through Talaaq Baain.

و الخلع يكون علي بلفظ البيع و الشراء و الطلاق و المبارأة

و اما ركنه : فهو الايجاب و القبول ، لانه عقد علي الطلاق بعقض فلا يقع الفرقة ، و لا يستحق العوض بدون القبول

و حكمه : وقوع الطلاق البائن كذا في التبيين

 

 

(4)

لا يقع الطلاق بشيء من الفاظ الكناية الا بالنية
