\n\tSomeone who is 50% mentally disabled gave Talaq 3 times to his wife. He knows and understands what Talaq is, but was not aware of the consequences. what is the ruling?<\/span><\/span>\n<\/p>\n

\n\tAnswer:<\/b><\/span><\/span>\n<\/p>\n

\n\tIn the name of Allah, the Most Gracious, the Most Merciful.<\/strong><\/span><\/span>\n<\/p>\n

\n\tFor divorce\/\u1e6dalaq to take place, one of the conditions is that the person issuing the \u1e6dalaq must be sane.<\/span><\/span>\n<\/p>\n

\n\tIm\u0101m al-K\u0101s\u0101n\u012b ra\u1e0d\u012bAll\u0101hu <\/span><\/span>\u02bbanhu said "And amongst the conditions of \u1e6dalaq is that he be sane, literally and figuratively. The \u1e6dalaq of an insane person is not affected, nor that of an immature boy, who is not of an understanding age." (Bad\u0101'i\u02bbu al-\u1e62an\u0101'i\u02bb, 4\/213).<\/span><\/span>\n<\/p>\n

\n\t\u02bbAl\u012b rad\u1ecbAll\u0101hu <\/span><\/span>\u02bbanhu said:<\/span><\/span>\n<\/p>\n

\n\t"Every divorce is effected except the divorce of the one who has lost his senses." (Sa\u1e25\u012b\u1e25 al-Bukh\u0101r\u012b, right before \u1e25ad\u012bth 5269).<\/span><\/span>\n<\/p>\n

\n\tRegarding your question, it would be best to consult a medical practitioner to determine the level of mental disability of this person (al-Fat\u0101w\u0101 al-Hindiyyah, 1\/526). If a medical practitioner is able to certify that the person does not understand talaq and its consequences, then the divorce will not have taken place. If, however, they are not able to certify this, then the divorce will have taken effect.<\/span><\/span>\n<\/p>\n
