Can she live with him?<\/span><\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<p style=\"text-align: center;\"><span style=\"font-family: verdana, geneva, sans-serif; font-size: 12pt;\"><strong><u>In the name of Allah, the Most Gracious, the Most Merciful<\/u><\/strong><\/span><\/p>\n<p><span style=\"font-family: verdana, geneva, sans-serif; font-size: 12pt;\"><strong><u>\u00a0<\/u><\/strong><\/span><\/p>\n<p><span style=\"font-family: verdana, geneva, sans-serif; font-size: 12pt;\"><strong><u>Answer:<\/u><\/strong><\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-family: verdana, geneva, sans-serif; font-size: 12pt;\">Sayyiduna Abu Huraira( \u0631\u0636\u0649 \u0627\u0644\u0644\u0647 \u0639\u0646\u0647 )narrates that the Messenger (\u0635\u0644\u0649 \u0627\u0644\u0644\u0647 \u0639\u0644\u064a\u0647 \u0648\u0633\u0644\u0645) of Allah said:<\/span><\/p>\n<p><span style=\"font-family: verdana, geneva, sans-serif; font-size: 12pt;\">\u0627\u0644\u0648\u064e\u0644\u064e\u062f\u064f \u0644\u0650\u0644\u0652\u0641\u0650\u0631\u0627\u0634\u0650\u060c \u0648\u0644\u0650\u0644\u0652\u0639\u0627\u0647\u0650\u0631\u0650 \u0627\u0644\u062d\u064e\u062c\u064e\u0631\u064f<\/span><\/p>\n<p><span style=\"font-family: verdana, geneva, sans-serif; font-size: 12pt;\">\u201cThe child will be attributed to the husband and the adulterer will receive the stone\u201d.<a href=\"#_ftn1\" name=\"_ftnref1\">[1]<\/a><\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-family: verdana, geneva, sans-serif; font-size: 12pt;\">The meaning of this Hadith is that the right of paternity will always be for the one to whom the mother of the child is married. Hence, paternity will not be established with the adulterer. If the woman is unmarried, the child will only be attributed to her.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-family: verdana, geneva, sans-serif; font-size: 12pt;\">Based on the above, it becomes clear that if one\u2019s father had illegitimate children from another woman, then they will not be attributed to him. His illegitimate children will not inherit from him, neither is he, Islamically, considered the father of these children. As such, the other legitimate children of his will not be considered their stepbrothers or stepsisters; hence the rules of Hijab will have to be observed.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-family: verdana, geneva, sans-serif; font-size: 12pt;\">However, this does not mean that marriage between them is permitted due to the fact that one may marry a non-Mahram. The jurists (fuqaha) state that it is unlawful for one to marry one\u2019s illegitimate daughter despite paternity not being established and her not inheriting from him.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-family: verdana, geneva, sans-serif; font-size: 12pt;\">The Majority of the scholars have declared with this verse,<\/span><\/p>\n<p><span style=\"font-family: verdana, geneva, sans-serif; font-size: 12pt;\">\u062d\u064f\u0631\u0651\u0650\u0645\u064e\u062a\u06e1 \u0639\u064e\u0644\u064e\u064a\u06e1\u0643\u064f\u0645\u06e1 \u0627\u064f\u0645\u0651\u064e\u0647\u0670\u062a\u064f\u0643\u064f\u0645\u06e1 \u0648\u064e\u0628\u064e\u0646\u0670\u062a\u064f\u0643\u064f\u0645\u06e1<\/span><\/p>\n<p><span style=\"font-family: verdana, geneva, sans-serif; font-size: 12pt;\">Prohibited to you for marriage are: Your mothers, daughters, sisters,<a href=\"#_ftn2\" name=\"_ftnref2\">[2]<\/a><\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-family: verdana, geneva, sans-serif; font-size: 12pt;\">\u0648\u0642\u064e\u062f\u0650 \u0627\u0633\u0652\u062a\u064e\u062f\u064e\u0644\u0651\u064e \u062c\u064f\u0645\u0652\u0647\u064f\u0648\u0631\u064f \u0627\u0644\u0639\u064f\u0644\u064e\u0645\u0627\u0621\u0650 \u0639\u064e\u0644\u0649 \u062a\u064e\u062d\u0652\u0631\u0650\u064a\u0645\u0650 \u0627\u0644\u0645\u064e\u062e\u0652\u0644\u064f\u0648\u0642\u064e\u0629\u0650 \u0645\u0650\u0646 \u0645\u0627\u0621\u0650 \u0627\u0644\u0632\u0651\u0627\u0646\u0650\u064a \u0639\u064e\u0644\u064e\u064a\u0652\u0647\u0650 \u0628\u0650\u0639\u064f\u0645\u064f\u0648\u0645\u0650 \u0642\u064e\u0648\u0652\u0644\u0650\u0647\u0650 \u062a\u064e\u0639\u0627\u0644\u0649<\/span><\/p>\n<p><span style=\"font-family: verdana, geneva, sans-serif; font-size: 12pt;\">\u0648\u0628\u064e\u0646\u0627\u062a\u064f\u0643\u064f\u0645\u0652 \u0641\u064e\u0625\u0646\u0651\u064e\u0647\u0627 \u0628\u0650\u0646\u0652\u062a\u064c<\/span><\/p>\n<p><span style=\"font-family: verdana, geneva, sans-serif; font-size: 12pt;\">The prohibition of marriage with a woman born out of one\u2019s unlawful relationship, due to the generality of Allah\u2019s statement: \u201cYour daughters\u201d because she (a girl born out of wedlock) is one\u2019s daughter hence she will be included in this generality. <a href=\"#_ftn3\" name=\"_ftnref3\">[3]<\/a><\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-family: verdana, geneva, sans-serif; font-size: 12pt;\">The reason being is that (the son or daughter born out of wedlock) is in reality one\u2019s own child.<\/span><\/p>\n<p><span style=\"font-family: verdana, geneva, sans-serif; font-size: 12pt;\">However, precaution is important in regards to marriage, thus one cannot make an analogy on inheritance.\u201d<a href=\"#_ftn4\" name=\"_ftnref4\">[4]<\/a><\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-family: verdana, geneva, sans-serif; font-size: 12pt;\">What the above is trying to say is that an illegitimate child is in reality and physically one\u2019s own child hence marriage is unlawful, for one cannot marry one\u2019s own daughter.
