How do we deal with late payment stipulations within contracts?<\/span><\/p>\n

 <\/p>\n

 <\/p>\n

In the name of All\u0101h<\/em>, the Most Gracious, the Most Merciful<\/u><\/strong><\/span><\/p>\n

 <\/p>\n

Answer:<\/u><\/strong><\/span><\/p>\n

 <\/p>\n

Any increase to the principal amount is considered Riba <\/em>(usury\/interest).<\/em> This is regardless of them being categorised as late fees, APR, prepayment fees, set up fees, admins fees and etc.<\/span><\/p>\n

 <\/p>\n

All of which have been made categorically prohibited by All\u0101h Ta\u2019\u0101l\u0101<\/em>;<\/span><\/p>\n

 <\/p>\n

\u201cThose who take rib\u0101<\/em> (usury or interest) will not stand but as stands the one whom the demon has driven crazy by his touch. That is because they have said: \u201cSale is but like rib\u0101<\/em>.\u2019\u2019, while All\u0101h <\/em>has permitted the sale and prohibited rib\u0101<\/em>. So, whoever receives advice from his Lord and desists (from indulging in rib\u0101<\/em>), then what has passed is allowed for him, and his matter is up to All\u0101h<\/em>. As for the ones who revert back, those are the people of Fire. There they will remain forever.\u201d [Surah al-Baqarah; 2:275<\/em>] [1]<\/span><\/p>\n

\u201cO you who have believed, do not consume usury, doubled and multiplied, but fear All\u0101h <\/em>that you may be successful.\u201d [Surah Al-Imr\u0101n; 3:130<\/em>] [2]<\/span><\/p>\n

 <\/p>\n

\u201cAnd for their charging Rib\u0101<\/em> (usury or interest) while they were forbidden from it, and for their devouring of the properties of the people by false means. We have prepared, for the disbelievers among them, a painful punishment.\u201d [Surah an-Nis\u0101\u2019; 4:161<\/em>] [3]<\/span><\/p>\n

The Prophet \ufdfa forbade the use of the price of blood and the price of a dog, the one who takes (eats) usury the one who gives usury, the woman who practises tattooing and the woman who gets herself tattooed. [Sahih al-Bukh\u0101ri: Hadith 5945<\/em>] [4]<\/span><\/p>\n
