If a man has consigned the right of divorce to his wife, can anything be done to remove that?<\/span><\/p>\n

 <\/p>\n

 <\/p>\n

In the name of <\/b><\/u>All<\/b><\/u><\/i>\u0101<\/b><\/u><\/i>h<\/b><\/u><\/i>, the Most Gracious, the Most Merciful<\/b><\/u><\/span><\/p>\n

Answer:<\/b><\/u> <\/i><\/span><\/p>\n

 <\/p>\n

Uttering the words of Talaq<\/i> (divorce) falls under two categories; Sareeh<\/i> (clear wording) and Kin\u0101yah<\/i> (vague wording).\u00a0<\/span><\/p>\n

 <\/p>\n

If clear wordings are used such as: \u201cI divorce you\u201d \u201cYou are divorced\u201d or \u201cI give you Tal\u0101q<\/i>\u201d whether they be said in person or not, via message, with witnesses present or not, etc. then this will cause Tal\u0101q<\/i> (divorce) to occur immediately. The wife will then need to enter into Iddah<\/i>.<\/span><\/p>\n

 <\/p>\n

The inference of such wording would mean Tal\u0101q Raj\u2019i<\/i> will occur which would subsequently allow for reconciliation to take place within the Iddah<\/i> period without the need of renewing the Nik\u0101h<\/i>. Verbally uttering words or gesturing to her to return would be sufficient for the marriage to renew. Even looking at her with desire and lust would also have the same effect. However, the use of vague wording where ambiguity remains (i.e., using such wordings which would not normally infer divorce) will require an intention of divorce to be present at the time of using such wordings. If an intention of divorce is not made when using such wordings, then Tal\u0101q<\/i> will not take place. Examples of such wordings would be: \u201cI free you\u201d \u201cI release you,\u201d or \u201cget out of here,\u201d or \u201cI don\u2019t want to see you again\u201d etc. [Al-Hid\u0101yah: vol. 2, pg. 391-392<\/i>] [2]<\/span><\/p>\n

Simply uttering the words of Tal\u0101q<\/i> alone is not sufficient for Tal\u0101q<\/i> to take place. They need to be directed towards somebody, either by saying it directly to them or by mentioning the wife\u2019s name.<\/span><\/p>\n

\nAfter the husband has assigned the right of Tal\u0101q<\/i> to his wife, he cannot revoke this right. [Al Mabsoot lis-Sarakhsi: vol. 6, pg. 183<\/i>] [3]<\/span><\/p>\n

If he gave her this right based on any conditions, then her right will only extend to this amount and not beyond. For instance, if he gave her the right of one Tal\u0101q<\/i>, she could not provide Tal\u0101Hq<\/i> to herself twice or thrice. If she does so, then the second and third will be invalid.\u00a0<\/span><\/p>\n

If it was conditional on a time frame, then her right becomes revoked after this period lapses.\u00a0<\/span><\/p>\n
