Question:<\/u><\/strong><\/span><\/p>\n

 <\/p>\n

Is the following statement a kinaya statement? The wife is rude and the husband says to the wife, Enough is Enough?<\/span><\/p>\n

 <\/p>\n

 <\/p>\n

In the name of Allah, the Most Gracious, the Most Merciful<\/u><\/strong><\/span><\/p>\n

 <\/p>\n

Answer: <\/u><\/strong><\/span><\/p>\n

 <\/p>\n

The above-mentioned words which were said during an argument are in fact \u2018 kinaayah’ words, ie. they are ambiguous words which could either mean \u2018divorce\u2019 or not.<\/span><\/p>\n

 <\/p>\n

If the husband did not have a firm resolve of talaq by the above-mentioned kinaayah words, then the statement would not constitute talaq.<\/span><\/p>\n

 <\/p>\n

A kinaayah statement will only constitute talaq if the husband intended \u2018talaaq\u2019 with the statement.<\/span><\/p>\n
