Question:<\/u><\/strong><\/span><\/p>\n

 <\/p>\n

If the father touches the bare skin of his stepdaughter with lust because he thought that was his wife but he moves away his hand immediately when he knows that was his stepdaughter, not his wife. The lust was for the wife not for the stepdaughter. Will it constitute hurmat musharat.<\/span><\/p>\n

Answer:<\/u><\/strong><\/span><\/p>\n

 <\/p>\n

In principle the Nikah should break due to the condition of Hurmat Musaharah was found according to the mainstream Hanafi scholars. (1)<\/span><\/p>\n

 <\/p>\n

However, some of the jurists take a more lenient approach as due to the changing of times, increase in sins, people becoming more corrupt and not having the level of Taqwah amongst people as before.<\/span><\/p>\n

The Prophet Sallallahu Alahi Wasalm said;<\/span><\/p>\n

“Allah has forgiven my nation for mistakes and forgetfulness, and what they are forced to do.”<\/span><\/p>\n

Ibn Majah 2045<\/em><\/strong><\/span><\/p>\n

 <\/p>\n

Because this was an honest mistake in the situation mentioned above, we can take a softer approach for this specific case and the marriage did not break. (2)<\/span><\/p>\n
