 <\/p>\n

Assalamualikum. If a woman says before marriage, “I am divorced if my husband gives me the right to divorce after marriage”, will she be divorced after marriage if her husband gives her the right to talaq? Please answer according to hanafi fiqh.<\/span><\/p>\n

In the name of Allah, the Most Gracious, the Most Merciful<\/strong><\/u><\/span><\/p>\n

Answer:<\/strong><\/u><\/span><\/p>\n

 <\/p>\n

The right to divorce primarily belongs to the husband, not the wife. However, if before the marriage contract, the woman demands the right to divorce herself upon marriage, and the man agrees by saying, \u201cIf I marry you, then you have the right to issue one irrevocable divorce upon yourself,\u201d this delegation is valid.<\/span><\/p>\n

 <\/p>\n

If the man did not attribute this to the marriage, the delegation is void.<\/span><\/p>\n

 <\/p>\n

Similarly, if this delegation takes place at the time of contracting the marriage, with the woman saying, \u201cI marry myself to you on the condition that I will have the right to divorce myself whenever I wish,\u201d and the husband responds, \u201cI accept this,\u201d then the delegation is valid. However, if this was proposed from the husbands side, the woman will not have the right to divorce herself.<\/span><\/p>\n

In both cases, the key factor is whether the husband delegated the right to divorce or approved such a clause. If neither occurred, talaaq is not issued although she has uttered such wordings.<\/span><\/p>\n
