When a bank sells a house under a power of sale and the buyer takes out a mortgage from the same bank, the sale and the mortgage loan are generally treated as two separate contracts. The sale contract pertains to the transfer of the property from the bank to the buyer, while the mortgage contract outlines the terms of the loan that the buyer is taking out to finance the purchase.<\/span><\/p>\n

A power of sale allows a lender to sell a property without court intervention to recover the outstanding mortgage balance when the borrower defaults. This process is typically quicker and less expensive than foreclosure.
