There is a person who filed for a civil divorce and stated in it that, “This also constitutes an Islamic divorce.” He intended 3 talaq. Does it count as 3 or 1?<\/span><\/p>\n

Answer:<\/strong><\/u><\/span><\/p>\n

 <\/p>\n

Muslims living in western countries generally have two aspects of their marriage. The Civil aspect and the Shar\u2019ee aspect. It is important to separate the two, as both are not contingent on one another and function independently.<\/span><\/p>\n

 <\/p>\n

In principle, a civil divorce does not constitute an Islamic divorce (<\/strong>talaaq<\/em>). The judge presides over the rulings and implications of a civil divorce. He does not have jurisdiction over a Shar\u2019ee divorce (talaaq<\/em>) and neither is that his mandate.<\/span><\/p>\n

 <\/p>\n

If the husband issued a civil divorce to his wife or he does not contest his wifes application for a civil divorce and in both instances the husband has no intention to issue a Shar\u2019i talaaq, the civil divorce will not constitute a talaaq in Shariah<\/span><\/p>\n

 <\/p>\n

If a person signed the civil divorce document and also intended a Shar\u2019ee\u00a0talaaq,\u00a0<\/em>then only<\/strong>\u00a0talaaq<\/em>\u00a0will take place.<\/span><\/p>\n

 <\/p>\n

Therefore, the divorce papers issued by the civil courts are deemed effective so long as your spouse also agreed to, and signed the papers with the intention of talaq.<\/span><\/p>\n

 <\/p>\n

As for your question if 3 talaq was intended then this will constitute talaq mu’allazah and the marriage between you are terminated.<\/span><\/p>\n
