Asalamu Alaikum esteemed Shaykh, I am a Sunni Muslim and I am want to marry my future wife, who\u2019s originally from a Dawoodi Bohra (Ismaili) background. She left the sect, and we want to get married, but her Bohri (Ismaili) father will certainly refuse to be a wali for a Sunni marriage. Are there any solutions to get married anyway?<\/span><\/p>\n

Answer:<\/strong><\/span><\/p>\n

 <\/p>\n

If a mature, sane woman gets married without the approval of her parent\/guardian (wali)<\/em>, the nika<\/em>\u0304<\/em>h <\/em>will be valid. However, to do so is against islamic <\/em>values and morals. The nikah <\/em>will be valid if the person she is getting nika<\/em>\u0304<\/em>h <\/em>to is compatible and a suitable match for her (kuf\u2019). <\/em>If the person is not a suitable match the nika<\/em>\u0304<\/em>h <\/em>will not be valid.<\/em><\/span><\/p>\n

 <\/p>\n

It is now clear that for the validity of a nikah <\/em>a wali <\/em>is not compulsory according to the Hanafi<\/em>\u0304<\/em> school. However, it is highly recommended that she has a wali<\/em> for the nika<\/em>\u0304<\/em>h<\/em>. The wali<\/em> should be a male, Muslim representative from her family, non-Muslims cannot be a wali. <\/em>If she has no Muslim, male wali <\/em>she may choose someone who is considered trustworthy and noble in the community like a scholar or an Ima<\/em>\u0304<\/em>m.<\/em><\/span><\/p>\n

 <\/p>\n

In the scenario mentioned in the question, the nika<\/em>\u0304<\/em>h <\/em>will be valid without the approval of the Shi\u2019a <\/em>guardian and she should appoint someone from the community: Ima<\/em>\u0304<\/em>m<\/em> etc, to be the wali.<\/em><\/span><\/p>\n
