When I came back, my daughter said happily \u201cMama is here\u201d to which my husband replied \u201cWe had divorced Mama, right?\u201d by which he meant that they are a team at home. But I really got worried and said to him that \u201cDon&#8217;t say such words\u201d to which he replied \u201cI didn&#8217;t say anything like that\u201d and explained to me what he said at that time. I want to know about the ruling of this is. Is it counted as divorce? I&#8217;m in doubt as he used the word \u201cWe\u201d?<\/span><\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<p style=\"text-align: center;\"><span style=\"font-family: verdana, geneva, sans-serif; font-size: 12pt;\"><strong>In the name of Allah, the Most Gracious, the Most Merciful<\/strong><\/span><\/p>\n<p><span style=\"font-family: verdana, geneva, sans-serif; font-size: 12pt;\"><strong>\u00a0<\/strong><\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-family: verdana, geneva, sans-serif; font-size: 12pt;\"><strong>Answer:<\/strong><\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400; font-family: verdana, geneva, sans-serif; font-size: 12pt;\">In the Shariah, divorce (Tal\u0101q) is divided into two types: \u1e62ar\u012b\u1e25 (explicit words) and Kin\u0101yah (implicit words).<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-family: verdana, geneva, sans-serif; font-size: 12pt;\"><b>Explicit Words (Tal\u0101q Sar\u012bh)<\/b><\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-family: verdana, geneva, sans-serif; font-size: 12pt;\"><span style=\"font-weight: 400;\">These are clear, direct terms and wording that undoubtedly signify divorce. Raddul Muhtaar defines it as: \u201cthat which establishes its legal ruling without intention, and he meant by what is the word or what takes its place from clear writing or an understandable sign.\u201d<\/span><span style=\"font-weight: 400;\">[1]<\/span><span style=\"font-weight: 400;\"> Fatawa Hindiyyah explains \u201cIt is as like [saying] you are \u2018Taaliq\u2019, and \u2018Mutallaqah\u2019, and \u2018I divorced you\u2019 (I gave you Talaaq). And one revocable divorce occurs, even if he intended more, or separation (Tal\u0101q B\u0101in), or he did not intend anything.\u201d<\/span><span style=\"font-weight: 400;\">[2]<\/span><span style=\"font-weight: 400;\"> In cases of explicit statements, no intention of divorce is required for divorce to occur. The words alone are enough.<\/span><\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-family: verdana, geneva, sans-serif; font-size: 12pt;\"><b>Implicit Words (Kin\u0101yah)<\/b><\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-family: verdana, geneva, sans-serif; font-size: 12pt;\"><span style=\"font-weight: 400;\">Kin\u0101yah refers to indirect or ambiguous phrases that could imply divorce but may also have other meanings. These words do not result in an automatic divorce and require the intention for divorce to occur. Raddul Muht\u0101r states that \u201caccording to the jurists (is whatever that was not stipulated for it) i.e. divorce (and has the possibility of it [divorce]) and other than it.\u201d<\/span><span style=\"font-weight: 400;\">[3]<\/span><span style=\"font-weight: 400;\"> Fatawa Hindiyyah states that \u201cDivorce does not occur with them except with intention or by the indication of a situation.\u201d<\/span><span style=\"font-weight: 400;\">[4]<\/span><\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-family: verdana, geneva, sans-serif; font-size: 12pt;\"><b>Using the Word \u201cWe\u201d in Divorce<\/b><\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400; font-family: verdana, geneva, sans-serif; font-size: 12pt;\">In the Arabic language, the pronoun \u201cWe\u201d can sometimes imply a single person in a representative sense, as seen in the many examples in the Quran where Allah SWT refers to Himself using \u201cWe\u201d. This is known as the royal \u201cWe\u201d and Tal\u0101q would occur with this. If the royal \u201cWe\u201d was not used, the word \u201cWe\u201d implies a group of people performing an action together. Even though your daughter was not capable of giving Tal\u0101q, your husband most definitely was. Since your daughter cannot initiate divorce, your husband\u2019s words alone would be considered.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-family: verdana, geneva, sans-serif; font-size: 12pt;\"><b>Analysis of Your Case<\/b><\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-family: verdana, geneva, sans-serif; font-size: 12pt;\"><span style=\"font-weight: 400;\">However, the word \u201cWe\u201d here does not inherently impact the ruling on divorce. Because your husband phrased the statement as a question, this statement would require inspection. Fatawa Hindiyyah states \u201cIf he said to her, \u2018Didn\u2019t I divorce you yesterday?\u2019 \u2018Had I not divorced you yesterday?\u2019 then this is an admission from him of both the marriage and the divorce. If he said, \u2018Did I divorce you yesterday?\u2019 then this is an admission of the marriage, but not an admission of the divorce.\u201d<\/span><span style=\"font-weight: 400;\">[5]<\/span><span style=\"font-weight: 400;\"> The second statement only asks if a divorce occurred while the first two statements indicate a divorce was given in an interrogative manner. Unfortunately, your husband\u2019s statement most resembles the first scenario based on the sentence structure and affirming it with the word \u201cright\u201d. This would count as an admission of marriage and divorce. Therefore, a Tal\u0101q Raj\u2019i (revocable divorce) had occurred and you should have started your \u2018Iddat. If your husband decides to keep you as his wife, he will now have one less Tal\u0101q Raj\u2019i out of three, and if this was the third Tal\u0101q, you would have to marry someone else.<\/span><\/span><\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-family: verdana, geneva, sans-serif; font-size: 12pt;\"><span style=\"font-weight: 400;\">Please remember that Tal\u0101q is a grave issue and be mindful of bringing it up even jokingly. The Prophet (\ufdfa) said \u201cThere are three things which, whether undertaken seriously or in jest, are treated as serious: Marriage, divorce and taking back a wife (after a divorce which is not final).\u201d<\/span><span style=\"font-weight: 400;\">[6]<\/span><\/span><\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-family: verdana, geneva, sans-serif;
