I need a help with the following matters. I would like to know what Sharia saying about this. My brother-in-law and I bought a property in London in 2013. The price was 165000 and bought through a bank mortgage.<\/span><\/p>\n

 <\/p>\n

When we bought we agreed we live together and when we have more money or property go up we will move into a big house or buy two separate houses.<\/span><\/p>\n

 <\/p>\n

Now the property price is 330000.<\/span><\/p>\n

 <\/p>\n

The bank mortgage balance is 100000.<\/span><\/p>\n

 <\/p>\n

I asked my share because I want to move somewhere else.<\/span><\/p>\n

 <\/p>\n

What is my share in the property at the movement even though we don’t want to sell the house. My brother in law wants to keep the house.<\/span><\/p>\n

Answer:<\/strong><\/span><\/p>\n

 <\/p>\n

Whenever buying properties from the bank, or using the banks resources – you need to ensure that no interest is involved. This is due to interest and usury being forbidden in Islam. Based on the price fluctuation, and the value of the property increasing, therefore the outcome from the property you originally invested in will be more and will be distributed between you and your brother according to percentages. However much each of you put in, will be calculated fairly and accordingly for the amount which you will each want to take out, should and if you decide to do so.<\/span><\/p>\n

 <\/p>\n

Relating to your question, at the time you valued the property, it was calculated at \u00a3330,000. If the original amount which you put in was 50% of 165,000 then you would be entitled to 50% of the new valued figure of 330,000. Your brother can keep his share of the house.<\/span><\/p>\n

 <\/p>\n

As a partnership, you have to do things in accordance and with agreement. He is not entitled to your share more than you are because that is your share. You may gift money or a percentage from your share to him but you are entitled to your share. If it is difficult for him to maintain the property all by himself, he could seek an agreement with the potential new owner.<\/span><\/p>\n

 <\/p>\n

Your share in the property is according to the original amount which you invested in the property which was 50%. You will still have to pay off the amount which You bought through a bank mortgage. You will not be due to receive any excess of the money which you had originally invested into the property.<\/span><\/p>\n
