Question:<\/strong><\/span><\/p>\n

 <\/p>\n

A couple signs a document of Khul\u2019a and put it in a drawer in house for some benefit they wanted to achieve thinking it was not a real divorce as they did not have intention of doing so.<\/span><\/p>\n

 <\/p>\n

There is now a dispute between the two, husband claiming she is no more his wife but wife disagrees.<\/span><\/p>\n

 <\/p>\n

So, It is a binding divorce as intention or witnesses aren\u2019t a requirement based on Hanafi Fiqh.<\/span><\/p>\n

 <\/p>\n

Is that so?<\/span><\/p>\n

 <\/p>\n

Khula refers to the husband issuing his wife divorce in exchange of returning the mahr or some monetary exchange. Khula is valid only if the husband consents to the khula. In that case the khula will constitute a talaq bain (irrevocable divorce).<\/span><\/p>\n

 <\/p>\n

Therefore intention and witness are not a condition here. What is important is the consent of the husband in making khula upon the request of the wife. Hence by the husband agreeing and signing the document the talaq will be effective.<\/span><\/p>\n
