Question:<\/strong><\/span><\/p>\n

If a husband and wife marry on the condition that if he divorces her, he will have to pay her $30,000 for instance, or half his house, will this be binding on him if he divorces?<\/span><\/p>\n

 <\/p>\n

Will it be halal for her to take it?<\/span><\/p>\n

Answer:<\/strong><\/span><\/p>\n

 <\/p>\n

Nikah is done with ijab and qubool (proposal and acceptance) in the presence of two witnesses. As mentioned in Quduri: “Nikah is contracted with a proposal and acceptance. It only gets contracted in the presence of two free, mature males.”<\/span><\/p>\n

 <\/p>\n

As such, if there is a condition stating that if there is a divorce, the party will have to pay a specific amount or give a portion of the house, it will be treated like a promise which will be considered wajib to fulfil and one will be sinful in his failure to act upon the promise made before the marriage.\u00a0<\/span><\/p>\n
