I am currently working two jobs, however my first job has written in my contract that I agree to inform them if I undertake any additional employment paid or unpaid. I have not let them know yet of my second job as I have only had it for a month. I am fulfilling all responsibilities and carrying out all duties expected of me in my first job. does me not following the part of my contract stated above make my income from the first job haram?\u00a0<\/span><\/p>\n

If it is haram, do I need to do anything aside from making Tawbah?<\/span><\/p>\n

Answer:<\/strong><\/span><\/p>\n

You\u2019re asking whether\u00a0not informing them\u00a0renders your\u00a0income haram, and what is needed in terms of\u00a0tawbah or rectification.<\/span><\/p>\n

Income becomes haram if:<\/span><\/p>\n

The work itself is haram (e.g., gambling, alcohol, etc.) The method of earning involves\u00a0fraud, deception, or breach of trust. You are being\u00a0paid for duties you are not fulfilling In your case: The work is\u00a0halal You are\u00a0fulfilling your duties completely You are\u00a0not deceiving them in terms of performance The only issue is\u00a0not informing them\u00a0of your second job, which is a\u00a0violation of contract terms, but it is \u00a0not necessarily fraud or deception,\u00a0if it does not harm them or cause breach of trust.\u00a0Therefore, according to most Hanafi scholars, your income is\u00a0not haram, as long as:<\/span><\/p>\n

You are\u00a0not lying about your availability.<\/span><\/p>\n

 <\/p>\n

In\u00a0Islamic contract law (\u02bfuq\u016bd), the conditions you agree to\u2014unless they contradict Shari\u2019ah\u2014are\u00a0binding. Not informing them is a\u00a0violation of a condition, and\u00a0this requires tawbah, but\u00a0does not invalidate your wage\u00a0unless the work itself is compromised.<\/span><\/p>\n

Make sincere tawbah:<\/span><\/p>\n

Admit the mistake before Allah Resolve not to repeat it Intend to inform your employer moving forward (if possible)<\/span><\/p>\n

Inform your employer now if it is possible and wise to do so, if there are no serious consequences, it is better to fulfil the condition now to clear your conscience. <\/span>You do NOT need to return any wages, because your wage was earned through actual, lawful work. <\/span>If you continue hiding it knowingly with harm or deception, then it becomes questionable, and action may be required.<\/span><\/p>\n
