My wife agreed but I refused. My daughter and the boy have chosen to go ahead anyway despite my refusal. In Hanafi opinion a wali is not necessary but kafaa has to be present.\u00a0 In Hidaya (fasl fil kafaa, p45 vol3) it states that if either mahr or nafaqah are not present then there is no kafaa. The boy is an apprentice engineer. His apprentice job is due to finish within 6 months. <\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-family: verdana, geneva, sans-serif;\">After that there is no guarantee of a job. If he fails, it will be very hard for him to find one. If he passes, there is still no guarantee of a job as the employer is not obliged to keep the apprentice.\u00a0 The apprentice job is the boy\u2019s only means of regular income and he has no other job.\u00a0 Is the condition of nafaqah met at present, or is it necessary for the boy to wait and secure a permanent job first?<\/span><\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<p style=\"text-align: center;\"><span style=\"font-family: verdana, geneva, sans-serif;\"><strong>In the name of Allah, the Most Gracious, the Most Merciful<\/strong><\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-family: verdana, geneva, sans-serif;\"><strong>Answer:<\/strong><\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-family: verdana, geneva, sans-serif;\">Your understanding is correct, that if your son-in-law is unable to provide a reasonable Mahr and Nafaqah (spending) for you daughter, then they are not considered compatible according to Shariah. Whilst you do have the right to separate between them, it is advisable that you be cautious in exercising this right. This is due to several factors;<\/span><\/p>\n<p>&nbsp;<\/p>\n<ul>\n<li><span style=\"font-family: verdana, geneva, sans-serif;\">Your daughter clearly likes this boy. While her judgment may not be as sound as your judgement, you will be upsetting your daughter by separating her from her husband. She may fall into depression and she may resent you for separating her from her husband.<\/span><\/li>\n<li><span style=\"font-family: verdana, geneva, sans-serif;\">The fact that your daughter went behind you back and got married to this boy without your consent must be quite upsetting for you. However as a father, you should be content that at least they chose the Halal option and performed their Nikah. If you separate this couple, there is a chance that they may opt to continue secretly seeing each other and become involved in a Haram relationship.<\/span><\/li>\n<li><span style=\"font-family: verdana, geneva, sans-serif;\">Your wife seems to believe that this boy is suitable for your daughter. Perhaps she has a valid reason for why she supports this marriage.<\/span><\/li>\n<li><span style=\"font-family: verdana, geneva, sans-serif;\">In this day and age, it is much harder for young men to become financially stable. In the beginning of the marriage, men can often have issues providing for their wife. <strong>If this boy seems to be ambitious, hard working, and has good character, then perhaps you can be patient with him due to the high likelihood that he will achieve financial stability soon in sha Allah<\/strong>.
