My father passed away in 2008, my father’s youngest brother passed away in 2009. My father’s oldest brother is still alive. My Dadi Ma passed away in 2012. My father left behind a wife, 5 daughters and 1 son.<\/span><\/p>\n

 <\/p>\n

In 2025, we received from my dad’s share of land back in India up to \u00a338,000. Would my grandma receive a share of this? From that share would both my uncles inherit from that money or would my elder uncle only receive money from this being the only alive surviving son?<\/span><\/p>\n

 <\/p>\n

The distribution of inheritance occurs after funeral expenses, debts and possible bequests to non-heirs (up to a third) has been paid. Thereafter, all assets and property are to be distributed together as soon as possible according to the Islamic rules of inheritance to all surviving heirs.[1]<\/sup><\/span><\/p>\n

 <\/p>\n

The inheritance left behind by your deceased father would therefore be due to all heirs that were still alive when he passed away, such as his mother (your grandmother). Since your father had a son at the time of his passing, his brothers (your uncles) would not have been due any shares from his assets.[2]<\/sup><\/span><\/p>\n

 <\/p>\n

The share of inheritance that was due to your grandmother should now be distributed to all of her heirs that were still alive at the time of her passing. No grandchild would inherit from your grandmother since she had a son (your elder uncle) who was alive at her passing. As your father and his younger brother were both deceased, there would not have been a share allocated to them from your grandmother\u2019s inheritance.[3]<\/sup><\/span><\/p>\n
