My husband said he wants to divorce me and that I am free from his side. Does that mean he\u2019s divorced me? Is it still okay for me to live with him?<\/span><\/p>\n

Answer:<\/strong><\/span><\/p>\n

Implicit Words (Kin\u0101yah)<\/strong><\/span><\/p>\n

 <\/p>\n

Kin\u0101yah refers to indirect or ambiguous phrases that could imply divorce but may also have other meanings. These words do not result in an automatic divorce and require intention or a Talaq context for divorce to occur. Raddul Muht\u0101r states:<\/span><\/p>\n

 <\/p>\n

According to the jurists (is whatever that was not stipulated for it) i.e. divorce (and has the possibility of it [divorce]) and other than it.[1]<\/sup><\/span><\/p>\n

 <\/p>\n

Fatawa Hindiyyah explains:<\/span><\/p>\n

 <\/p>\n

Divorce does not occur with them except with intention or by the indication of a situation.[2]<\/sup><\/span><\/p>\n

 <\/p>\n

 <\/p>\n

Free From My Side<\/strong><\/span><\/p>\n

 <\/p>\n

The phrase \u201cfree from my side\u201d is a Kin\u0101yah phrase, as it could be used to imply divorce or mean something else. If your husband intended to divorce you through these words, one Tal\u0101q B\u0101in would occur. If he intended something else, Tal\u0101q would not occur.<\/span><\/p>\n

Reconciliation and Remarriage<\/strong><\/span><\/p>\n

 <\/p>\n

If this is the third Tal\u0101q, you would need to marry and consummate with someone else before the possibility of reconciliation. If it is the first or second Tal\u0101q, both of you would need to go through a Tajd\u012bd An-Nik\u0101h (renewal of the marriage) after the \u2018Iddat with a new Mahr if you want to remarry.<\/span><\/p>\n
