My wife has been suffering from mental illness since last year and we are living separate last week. During our chat I wanted to threaten her by saying I will to give you divorce I used the phrase I divorce you I divorce you I divorce you in future tense. After that I took an oath that I uttered these words for future tense. We went to local Qaazi in Saudi Arabia he considered its one divorce revocable.<\/span><\/p>\n

Answer:<\/strong><\/span><\/p>\n

 <\/p>\n

The mental health condition of the wife does not prevent a divorce from taking place, because the act of talaq is issued by the husband. So, if the husband gives a valid talaq, it is effective regardless of the wife’s condition.<\/span><\/p>\n

 <\/p>\n

If you had said, \u201cI will divorce you\u201d \u2014 this is in the future tense, and according to the Hanafi scholars, such a statement is a promise or threat, not an enactment. In that case, no divorce would take place.<\/span><\/p>\n

 <\/p>\n

However, you said, \u201cI divorce you, I divorce you, I divorce you\u201d, which is in the present tense, and the wording is clear and explicit (\u1e63ari\u1e25). In Hanafi fiqh, a clear statement of divorce does not require intention, it takes immediate effect once uttered.<\/span><\/p>\n
