Please tell me that in such condition divorce can be effective or not? in the state of intoxication, without doubts these two talaqs will occur according to the Hanafi Fiqh.<\/span><\/span><\/span>\n<\/p>\n<p>\n\t<span style=\"color:#000000;\"><span style=\"font-size: 14px;\"><span style=\"font-family: verdana,geneva,sans-serif;\">Ibn Abideen Shami <img title=\"ra\u1e25imahull\u0101h (may All\u0101h have mercy upon him)\" alt=\"ra\u1e25imahull\u0101h (may All\u0101h have mercy upon him)\" class=\"islamic_graphic\" src=\"https:\/\/daruliftabirmingham.co.uk\/wp-content\/plugins\/islamic-graphics\/img\/black\/20\/rahimahu.png\" height=\"12px\"> has said, &ldquo;The ruling is that if a person is intoxicated by using unlawful means, then he is not absolved of responsibility, and the rulings will apply to him.&rdquo;<\/span><\/span><\/span>\n<\/p>\n<p>\n\t<span style=\"color:#000000;\"><span style=\"font-size: 14px;\"><span style=\"font-family: verdana,geneva,sans-serif;\">In another place he says, &ldquo;If his sanity is affected by a headache or with any lawful thing, then talaq in that state will not be effected.&rdquo; (Raddul Muhtar p.444 v.4)<\/span><\/span><\/span>\n<\/p>\n<p>\n\t<span style=\"color:#000000;\"><span style=\"font-size: 14px;\"><span style=\"font-family: verdana,geneva,sans-serif;\">However, regarding the issuing of the second two talaqs, if the husband&#39;s mind and intellect was unbalanced and obscured, then such a person&rsquo;s talaq is ineffective and not valid.<\/span><\/span><\/span>\n<\/p>\n<p>\n\t<span style=\"color:#000000;\"><span style=\"font-size: 14px;\"><span style=\"font-family: verdana,geneva,sans-serif;\">Imam Kasani <img title=\"ra\u1e25imahull\u0101h (may All\u0101h have mercy upon him)\" alt=\"ra\u1e25imahull\u0101h (may All\u0101h have mercy upon him)\" class=\"islamic_graphic\" src=\"https:\/\/daruliftabirmingham.co.uk\/wp-content\/plugins\/islamic-graphics\/img\/black\/20\/rahimahu.png\" height=\"12px\"> has said &lsquo;And amongst the conditions of Talaq is that he be sane, literally and figuratively.&nbsp;
