Question:
I went to a person who makes documents and I asked him to make a divorce paper. He made the divorce paper which he had written himself.
From this wedlock, we could not settle together and neither of us emigrated to the other also no issue was born so finally I pronounced the Divorce and the Hag Maher is paid i.e. today on 18-07-2023 to her under the Muhammadan law verbally as well as through Divorced Deed as under:
I x hereby divorce you x
I x hereby divorce you x
I x hereby divorced you x.
He told me to sign and I signed the papers.
I haven’t said anything from my mouth he wrote everything.
I had no idea what is 1 2 or 3 talaq is.
I had no intention of triple talaq I promise by Allah swt. Even i had no inetntion of talaq. I had no number of talaq in my mind while singing the divorce paper.

Answer:
A written divorce is of two types:
1- Formal; which has a title and the sender and recipient are addressed.
2- Informal; which does not have a title or the names of the recipient and sender.
When a formal letter of divorce is written, the divorce will occur regardless of the husband’s intentions.
When the husband designates someone to write the divorce statement on his behalf, that person reads the document aloud to the husband, has it signed and stamped and the wife receives it, then the divorce will be finalized in writing if the husband confirms that this is his statement.
Asking someone to write a divorce letter to his wife will be considered a confirmation of divorce from the husband.
Based on the above, your marriage with your wife has been terminated and you will not be allowed to take her back. It will become permissible for you to remarry her after she has gone through another marriage with someone else and that person divorces her.

الكتابة على نوعين: مرسومة وغير مرسومة. ونعني بالمرسومة أن يكون مصدرا ومعنونا مثل ما يكتب الى الغائب؛ وغير المرسومة ان لا يكون مصدرا ومعنونا.

ولو قال للكاتب: اكتب طلاق امرأتي، كان إقرارا بالطلاق وان لم يكتب؛ ولو استكتب من آخر كتابا بطلاقها وقرأه على الزوج وختمه وعنونه وبعث إليها فأتاها، وقع أن أقر الزوج أنه كتابه، أو قال للرجل ابعث به إليها، أو قال له اكتب نسخة وابعث بها اليها؛ وان لم يقر أنه كتابه ولم تقم بينة لكنه وصف الأمر على وجهه لا تطلق قضاء ولا ديانة، وكذا كل كتاب لم يكتبه بخطه ولم يمله بنفسه لا يقع الطلاق ما لم يقر أنه كتابه اهـ ملخصا.
