Question:
Assalaamualaikum. If someone buys land in India in a village because it was a good price, knowing that they will likely sell it in the distant future so that they can settle in a bigger city, is there zakat on it? From what he’s saying, he didn’t really buy it with the express intention of selling it, but he knows he probably won’t settle in that rural area, so he will most likely sell it at some point
In the name of Allah, the Most Gracious, the Most Merciful
Answer:
Zakat is Wajib on things one purchases with the clear intention of re-selling (Badai Al Sanai, Vol 2, Pg 429). As he did not buy it with the express intention of selling it, Zakat will not be paid for it. If he sells the land, he should add the money he receives to his other Zakatable assets at the time and gives Zakat on that.
أما صفة هذا النصاب فهي أن يكون معدا للتجارة و هو أن يمسكها للتجارة و ذلك بنية التجارة مقارنة لعمل التجارة
Only Allah knows best.
