Husband Gave His Pregnant Wife a Talaq Raji

Question

 

I am pregnant in the 4th month and my husband divorced me once in written form on paper. After divorce, he wants to be normal and did ruju but after some days he sent me again to my parent’s house and wants separation. What is the status of the divorce and ruju?

 

 

In the Name of Allah, the Most Gracious, the Most Merciful.

 

Answer:

 

If a husband issues his wife one talaq, a talaq raji (revocable divorce) comes into effect. The husband can revoke the divorce within the period of iddat (three menstrual cycles or three months if the wife does not experience menses) whether she agrees or not.  [1]

 

The husband may revoke the divorce by verbally saying “I take you back” or “I have taken back my wife”. Having relations with her, kissing her, or touching with desire also revokes the divorce. [2]

 

Words that affect the divorce have two types:

 

  • Sareeh (clear wording): To clearly express the wordings of divorce, such as to say “I divorce you” or “you are divorced”. These words come into effect whether or not one has the intention of divorce.
  • Kinayah (ambiguous words): To ambiguously express wordings of divorce. Kinayah words do not come into effect unless one intends divorce by them. If the intention of divorce is present, one talaq (revocable divorce) comes into effect. [3]

 

As your husband revoked the divorce, one talaq occurred. It is advisable you tell him to be careful with his words so he does not regret anything later on. Once he issues three talaq, it will be almost impossible to get married again. Furthermore, merely sending you to your parent’s house does not affect the marriage unless he used an ambiguous statement with the intention of divorce.

وَأَلْفَاظُهُ: صَرِيحٌ، وَمُلْحَقٌ بِهِ وَكِنَايَةٌ(صريحه ما لم يستعمل إلا فيه) ولو بالفارسية (كطلقتك وأنت طالق ومطلقة)(قوله ما لم يستعمل إلا فيه) أي غالبا كما يفيده كلام البحر. وعرفه في التحرير بما يثبت حكمه الشرعي بلا نية
