Question:

Ex-husband divorced me 3 different times in anger, While he was affected by a very strong sihr, and not only one sihr but two. We did not know of it at that time. I had a very strong feeling about it because of his behaviour. He kept rejecting me for over a year, avoiding me at all time, he couldn't look me in the eyes and he couldn't smile to me. Even when I spoke kindly to him he reacted to me as if I was his worst enemy, he would start yelling at me as if I had done something bad to him. I kept telling him to find someone that could make Ruqya to him but he did not believe that sihr existed.

When around me he was like that, but on the phone sometimes He would listen to me, so every time I asked him why he was like that, and why we were together in a marriage when we did not act like a married couple at all. Acted like I was haram for him. His answer was always "I don't know, I'm going crazy, I don't know what's wrong with me, I can't think, my brain is going crazy, even my heartbeat is going crazy, I don't know why I'm like this, I do love you but I just don't know, I'm going crazy"

 I ran out of sabr after a year and a half living with someone that could stand the sight of me, so I asked him to move out and divorce me.

After the divorce, we kept in contact because of our son, and I kept telling him about sihr in Islam. And when he realized that I would not take him back (at this time we did not know that we were divorced 3 times) he kept begging me for forgiveness because I found out that he had something going on with his ex-wife before me, while we were married. She had cause us so many problems during our marriage, sending him naked photos and turning their kids against me and now that she knew we were on a break she wanted me to know that he had something with her, only to make sure that we would get divorced. She had always done everything to break us apart.

But when he kept begging me for a chance I asked him to find a raqi first of all. For him to go to a raqi it took him 10 months. In the meanwhile I kept sending him Ruqya shar'iya videos from YouTube so he could start doing it himself. Because he kept saying that he wanted to get back, but something was holding him back without knowing what it was.

The Raqi that I took him to after 10 months did Ruqya on him and said that he was strongly affected by two sihr, that a woman made double sihr on him, for him to only lust and obey her. In these 10 months, he had gotten better actually because of the Ruqya shar'iya and reading Quran, listening to the Quran and the fact that I would only take him back if he was healed. When the raqi started his readings on him, he was at a category 4/7, and he said anything above a category 2/7 is in a bad state of mind, making him crazy and not as himself anyone.

After the third time he to the reading process he started saying that he has a feeling that we had been divorced 3 times. I only remember two of the times were one of them was in a process of my 3idah meaning when he had divorced at the time that I threw him out, before my third 3idah I asked him to divorce me when I found out about what he had been talking about with his ex-wife. Another sheikh told us that this only counted as one talaq since my 3idah was not completed yet.

Now our question is, are we divorced 3 times or not? Can we get back together, since he had been affected by since threw out our whole marriage? He was in a unrecognizable state of mind. He had been affected by sihr for 5 years the Raqi said, and I have known my husband for 5,5 years now and married to him for 3 years. The man I knew then was not the man I was living with especially for the two last years of our marriage. And the man I know now looks more like the once I knew in the beginning. He is still in a healing process with the Raqi, and he is getting better alhamdulillah. And we really want to get back together, but we are afraid that the talaq might count.

With regards to your question, if the black magic was so severe that a person became insane and mad then on the basis of insanity talaq will not occur. (Raddul Muhtar p.451 v.4) However, if the person’s state was not so severe then talaq will occur. (Raddul Muhtar p.438 v.4)”

However, in circumstances where it is claimed that a person lost his sanity or black magic has been done upon him, it is necessary that the person has previous medical history of insanity or has been diagnosed by the doctor of being of unstable mind, or has two male witnesses or one male and two female witnesses testifying that on that occasion the person indeed lost his sanity due to the black magic.
