Destroying Zakat Wealth

CategoriesZakah [295]

Is there any difference in Zakat between halaaq and istihlaaq? Then if after the Shar’ee year somebody have 10000 rands. His zakate will be 250 rands. But before he give his zakate, he spend all 10000 rands (ex : he bought a car or food, any thing). Must he paid his 250 rands zakaate.

In the name of Allah, the most Beneficent, the most Merciful.

Answer

If a persons wealth is destroyed after zakat has been made wajib then he does not have to give zakat, regardless of whether the time for his giving the zakat has already passed or not.  This is known as Halak.  However if this person is purposefully destroying his wealth for whatever reason, zakat will still be binding upon him as this is Istihlaak.   (Ilmul Fiqh p.29 v.4)

With regards to your question, zakat will be wajib. This is similar to Istihlaak.
