Giving Talaq 3 Times in One Go

Question:

 

Please can you confirm to me that giving talaq 3 times in one go is the talaq valid or void i had no idea as to what i said at the time

 

In the name of Allah, the Most Gracious, the Most Merciful

 

Answer:

 

Divorce (in terms of what words are used) is of two types:

 

  1. Sareeh – where the words used are clear and only can be used for the purpose/meaning of divorce, these statements do not require an intention of divorce alongside it1
  2. Kinayah – where the words used are ambiguous and unclear but could be in the meaning of a divorce, these statements require an intention of divorce for a divorce to occur2

 

You say you have no idea what you said at the time, yet (I assume) remember saying divorce three times, divorce even if it is in a state of anger occurs so long as the anger was not to a level where he would be considered a mad person, meaning a person no longer in control of his words and actions 3.

 

If you reached such a level where you were not aware of your senses then no divorce occurred, you will need to ask yourself truly whether you were or not.

 

Three divorces in one go equal to three divorces, in such a case the woman is free to marry anyone else after her iddah.

2 Radd al-Muhtar (Dar Fikr, vol 3, pg 296)

بَابُ الْكِنَايَاتِ (كِنَايَتُهُ) عِنْدَ الْفُقَهَاءِ (مَا لَمْ يُوضَعْ لَهُ) أَيْ الطَّلَاقِ (وَاحْتَمَلَهُ) وَغَيْرَهُ (فَ) الْكِنَايَاتُ (لَا تَطْلُقُ بِهَا)

 

 

3 Radd al-Muhtar (Dar Fikr, vol 3, pg 244)

مَطْلَبٌ فِي طَلَاقِ الْمَدْهُوشِ وَقَالَ فِي الْخَيْرِيَّةِ: غَلِطَ مَنْ فَسَّرَهُ هُنَا بِالتَّحَيُّرِ، إذْ لَا يَلْزَمُ مِنْ التَّحَيُّرِ وَهُوَ التَّرَدُّدُ فِي الْأَمْرِ ذَهَابُ الْعَقْلِ. وَسُئِلَ نَظْمًا فِيمَنْ طَلَّقَ زَوْجَتَهُ ثَلَاثًا فِي مَجْلِسِ الْقَاضِي وَهُوَ مُغْتَاظٌ مَدْهُوشٌ، أَجَابَ نَظْمًا أَيْضًا بِأَنَّ الدَّهْشَ مِنْ أَقْسَامِ الْجُنُونِ فَلَا يَقَعُ، وَإِذَا كَانَ يَعْتَادُهُ بِأَنْ عُرِفَ مِنْهُ الدَّهَشُ مَرَّةً يُصَدَّقُ بِلَا بُرْهَانٍ
