Question:
1. Mehr, we are keeping 3k, but can we put a condition that if he gives talaq to my daughter then he must give her 30k
2. Can we have it written that if he wants to have a second nikah whilst in nikah of my daughter that he must get her permission?
In the name of Allah, the Most Gracious, the Most Merciful
Answer:
Mahr (dowry) is a right of the wife that is due to her upon the marriage contract, by her husband and it can be stipulated as a fixed amount. However, when it comes to adding conditions related to talaq or divorce, it is essential to understand that Mehr cannot be linked directly to the occurrence of talaq in this manner.
It is not permissible to add a condition stipulating an increase in Mehr if the husband gives Talaq. Mehr is the wife’s right, and it cannot be conditional upon the occurrence of Talaq or any other thing.
However, it is permissible to include a condition in the Nikah contract requiring the husband to obtain the wife’s permission for a second marriage, if both parties mutually agree. However, this condition cannot override the husband’s legal right to marry more than one wife.
