Question:
Anyone have any fatawa regarding when people come to Jeddah to stay/do shopping etc, how long intention of staying in Jeddah before proceeding to Makkah do we say if a person doesn’t want to land in ihram?
In the name of Allah, the Most Gracious, the Most Merciful.
Answer:
One cannot attempt to subvert the ruling of Ihram by concealing their intention to enter the Haram for some period of time. Rather, the Hanafi opinion dictates that one intending to enter the Haram must wear Ihram for Umrah or Hajj, regardless of the purpose of their visit. As such, knowing that they intend to proceed to Makkah, they must wear Ihram before crossing the Miqat even if they intend to stay in Jeddah first, otherwise they will become liable for Dam [1].
However, if they do cross the Miqat and enter Jeddah without Ihram, they may avoid the Dam by returning to the Miqat at any time before leaving, entering into Ihram from there, and then heading to Makkah and performing Umrah [2]. But while one may be excused after doing this, to do so intentionally is not correct.
