Question:
Is aziziyah considered a part of Makkah?
In the name of Allah, the Most Gracious, the Most Merciful
Answer:
We are of the view that Aziziyah is not part of Mecca Mukarramah.
Aziziyah and Mecca Mukarramah will be treated as two separate places.
Therefore, if one intends to take up residence in Mecca and Azizia jointly for fifteen days, then he will be considered a Musāfir as long as 15 days is not spent in one of the two places consecutively.
1 (وَشَرْطُ افْتِرَاضِهَا عَقْلٌ وَبُلُوغٌ وَإِسْلَامٌ وَحُرِّيَّةٌ)

2 (قَوْلُهُ عَقْلٌ وَبُلُوغٌ) فَلَا تَجِبُ عَلَى مَجْنُونٍ وَصَبِيٍّ لِأَنَّهَا عِبَادَةٌ مَحْضَةٌ وَلَيْسَا مُخَاطَبَيْنِ بِهَا، وَإِيجَابُ النَّفَقَاتِ وَالْغَرَامَاتِ لِكَوْنِهَا مِنْ حُقُوقِ الْعِبَادِ وَالْعُشْرِ، وَصَدَقَةِ الْفِطْرِ لِأَنَّ فِيهِمَا مَعْنَى الْمُؤْنَةِ.
