Can a Husband Revoke Talaq Rajee During Iddah After Khulaa Requests?

Question:

 

If a woman asks for khulaa and after 2 letters are sent to the man, with 1 month’s gap between the 2. And before the 3rd one gets sent, the man gives 1 written divorce stating that it is talaaq rajee.

 

Is that a revocable or irrevocable divorce? I mean, will the 2 letters of khulaa count for anything? If he says to his family member, that he wants her back, straight after signing the paper, will they still be married?

Answer:

 

In this case, the husband granted a revocable divorce (talaq rajee). According to the Hanafi school, when a revocable divorce is granted, the marriage remains intact during the iddah (waiting period). The divorce can be revoked, and the couple may reach an agreement during this time.

 

The nature of the revocable divorce is unaffected by the wife’s letters. They will remain married as long as the husband expresses a desire to take her back within the iddah.
