Doing Tawbah After Committing Oral Sex

Question:

 

I did oral sex with my girlfriend, not sexual intercourse. I am distraught because I believe in Allāh. I stopped all these unlawful things and have made tawbah repenting many times. Is it equivalent to zinā which requires the add capital punishment?

 

 

In the name of Allāh, the Most Gracious, the Most Merciful

 

Answer:

 

If you have made sincere tawbah (repentance) from your sin, are remorseful and have made a firm resolution never to repeat the wrong, you are on the right track. Keep striving to learn, practice and be firm on the religion.

 

 

In Islām, even though oral sex with an unlawful partner is sinful and a form of zinā, it does not mandate add (capital punishment) under Islamic law. – (See: Rad Al-Muḥrār, Vol 4, Page 7, Dār Al-Fikr)[1]

 

 

“O you who have believed, repent to Allāh with sincere repentance. Perhaps your Lord will remove from you your misdeeds and admit you into gardens beneath which rivers flow.” – (Qur’ān 66:8)[2]

 

 

“A man kissed a [non-mahram] woman and then came to Allāh’s Messenger (peace and blessings be upon him) and told him of that [sin], so this Divine Inspiration was revealed to the Prophet (peace and blessings be upon him) ‘And offer prayers at the two ends of the day, and in some hours of the night; (five) compulsory prayers. Verily, good deeds remove evil deeds (minor sins). That is a reminder for the mindful.’ (Qur’ān: 11:114) The man asked, “Is this instruction for me only?” The Prophet (peace and blessings be upon him) said, “It is for all those of my followers who encounter a similar situation.” – (Ṣaḥīḥ Bukhārī 4687)[3]

[1] وَالزِّنَا الْمُوجِبُ لِلْحَدِّ وَطْءُ وَهُوَ إدْخَالُ قَدْرِ حَشَفَةٍ مِنْ ذَكَرِ مُكَلَّفٍ خَرَجَ الصَّبِيُّ وَالْمَعْتُوهُ نَاطِقٍ خَرَجَ وَطْءُ الْأَخْرَسِ فَلَا حَدَّ عَلَيْهِ مُطْلَقًا لِلشُّبْهَةِ وَأَمَّا الْأَعْمَى فَيُحَدُّ لِلزِّنَا بِالْإِقْرَارِ لَا بِالْبُرْهَانِ شَرْحُ وَهْبَانِيَّةٍ طَائِعٍ فِي قُبُلِ مُشْتَهَاةٍ حَالًا أَوْ مَاضِيًا خَرَجَ الْمُكْرَهُ وَالدُّبُرُ وَنَحْوُ الصَّغِيرَةِ خَالٍ عَنْ مِلْكِهِ أَيْ مِلْكِ الْوَاطِئِ وَشُبْهَتِهِ أَيْ فِي الْمَحِلِّ لَا فِي الْفِعْلِ، ذَكَرَهُ ابْنُ الْكَمَالِ؛ وَزَادَ الْكَمَالُ فِي دَارِ الْإِسْلَامِ لِأَنَّهُ لَا حَدَّ بِالزِّنَا فِي دَارِ الْحَرْبِ أَوْ تَمْكِينُهُ مِنْ ذَلِكَ بِأَنْ اسْتَلْقَى فَقَعَدَتْ عَلَى ذَكَرِهِ فَإِنَّهُمَا يُحَدَّانِ لِوُجُودِ التَّمْكِينِ أَوْ تَمْكِينُهَا فَإِنَّ فِعْلَهَا لَيْسَ وَطْئًا بَلْ تَمْكِينٌ فَتَمَّ التَّعْرِيفُ وَزَادَ فِي الْمُحِيطِ الْعِلْمَ بِالتَّحْرِيمِ فَلَوْ لَمْ يَعْلَمْ لَمْ يُحَدَّ لِلشُّبْهَةِ وَرَدَّهُ فِي فَتْحِ الْقَدِيرِ بِحُرْمَتِهِ فِي كُلِّ مِلَّةٍ  – كتاب الدر المختار وحاشية ابن عابدين رد المحتار ج٤/ ص ٧ دار الفكر

 

 

[2] يَا أَيُّهَا الَّذِينَ آمَنُوا تُوبُوا إِلَى اللَّهِ تَوْبَةً نَّصُوحًا عَسَىٰ رَبُّكُمْ أَن يُكَفِّرَ عَنكُمْ سَيِّئَاتِكُمْ وَيُدْخِلَكُمْ جَنَّاتٍ تَجْرِي مِن تَحْتِهَا الْأَنْهَارُ – سورة التحريم ٨ ‎

 

 

[3] عَنِ ابْنِ مَسْعُودٍ رضى الله عنه أَنَّ رَجُلاً أَصَابَ مِنَ امْرَأَةٍ قُبْلَةً فَأَتَى رَسُولَ اللَّهِ صلى الله عليه وسلم فَذَكَرَ ذَلِكَ لَهُ فَأُنْزِلَتْ عَلَيْهِ ‏وَأَقِمِ الصَّلاَةَ طَرَفَىِ النَّهَارِ وَزُلَفًا مِنَ اللَّيْلِ إِنَّ الْحَسَنَاتِ يُذْهِبْنَ السَّيِّئَاتِ ذَلِكَ ذِكْرَى لِلذَّاكِرِينَ‏‏‏‏ قَالَ الرَّجُلُ أَلِيَ هَذِهِ قَالَ لِمَنْ عَمِلَ بِهَا مِنْ أُمَّتِي ‏- رواه البخاري ٤٦٨٧‏
